(214 November Court Anno Domini 1747 Chattles should be made and Levied to and for the use of the said George Scott If it should happen the said Robert Horner the Debt and Damages aforesaid to the said George should not pay or his body into the Custody of the sheriff by Reason thereof Render And the said Robert Horner by Henry Darnall his attorney Comes and defends the force and Injury when &C.a and prays leave thereof to Imparle here to until the Next Court to be holden at Charles Town on the Second Tuesday in March Next and he hath it and the same day is given to the same George here &Ca At which day to wit the Second Tuesday in March afs.d Comes here as well the said George as the said Robert by their attorneys aforesaid & the said Robert by his said attorney prays further Leave to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in June Next and he hath it and the same day is given to the same George here &Ca At which day to wit the second Tuesday in June afs.d Comes here as well the said George as the said Robert by their attorneys aforesaid & the said Rob.t by his said attorney prays further leave to Imparle here to until the next Court to be holden at Charles Town on the second Tuesday in August Next and he hath it and the same day os given to the same George here &C.a At which day to wit the second Tuesday in August afs.d Comes here as well the said George as the said Robert by their Attorneys afs.d and the said Robert by his said Attorney prays further leave to Imparle hereto until the Next Court to be holden at Charles Town on the second Tuesday in November Next and he hath it and the same day is given to the same George here &Ca And now here at this day to wit the second Tuesday in Nov.r aforesaid Comes as well the said George by his attorney afs.d as the said Robert by his Attorney afs.d and the said Robert by his said attorney aforesaid Comes and defends the force and Injury when &C.a and says that he Cannot deny the action afs.d of him the said George nor but that he did assume upon himself in manner and form as the said George above against him hath Complained nor also but that the said George hath sustained Damages by means of not performing the promises and assumptions aforesaid to Twenty seven pounds Sterling as the afs.d George above Supposes Whereupon the said George by his attorney afs.d prays Judgment and those Damages so acknowledged together with his Costs & Charges by him about his Suit in this part sustained to him to be adjudged Therefore it is Considered that the said George Recover against the said Robert his Damages to Twenty seven pounds sterling above acknowledged and also Three Hundred and Twelve pounds of Tobacco for his Costs and Charges by him about his suit on this part laid out and Expended on his Assent by the Court Def.t in mer here adjudged and the said Robert in Mercy &C.a |
