November Court Anno Domini 1747
(213) At which day to wit the second Tuesday in August afs.d Comes here as well the s.d Robert as the said James by their attorneys afs.d and the said James by his said attorney prays further Leave to Imparle hereto until the Next Court to be holden at Charles Town on the second Tuesday in November Next and he has it and the same day is given to the same Robert here &Ca And now hereat this day to wit the Second Tuesday in November afs.d Comes as well the said Robert by his attorney afs.d as the said James by his attorney afs.d and the said James by his said attorney Comes and defends the force and Injury when &C.a and says that he Cannot deny the action afs.d of him the s.d Robert nor but that he did assume upon himself in manner and form as the said Rob.t above against him hath Complained nor also but that the said Robert have sustained Damages by means of not Performing the Promises and Assumptions aforesaid to one Thousand pounds of Tobacco as the afs.d Robert above supposes Whereupon the said Robert by his attorney afs.d prays Judgment and those Damages so acknowledged together with his Costs and Charges by him about his suit in this part sustained to him to be adjudged Therefore it is Considered that the said Rob.t Recover against the said James his Damages to one Thousand pounds of Tob.o his Costs and Charges by him about his suit in this part laid out and Expended on Def.t in Mer his assent by the Court here adjudged and the said James in Mercy &Ca
It was Commanded the sheriff that he should take Robert Horner late of Charles Co.ty Merchant if &C.a and him safe keep so that he should have his body before the Justices of the Lord Proprietary of his Next County Court to be holden at Charles Town on the Second Tuesday in November Next to answer unto George Scott of a plea of Trespass upon the Case and that he should have then and there the Writt &Ca At which day to wit the Second ^Tuesday^ in November aforesaid Comes the said George by Thomas Clark his attorney and offers himself against the said Robert and the sheriff aforesaid Namely Sam.l Hanson Gent Returns to the Court here that he has taken the body of the said Robert Whereupon into Court herein his proper Person Comes William Middleton of Charles County Merchant and becomes Pledge and security for the afs.d Robert that if should happen that the afs.d George in the plea afs.d should be Convict that then the said William Middleton Yeilded and Granted that as well the Debt aforesaid as all Damages which to the same George in this part should be adjudged of his Lands & (Chattles) |
