(211) That now is his good Rule and Government wherefore the said Barton saith he is the Worse and hath Damage to the Value of one Hundred Pounds Current money of Maryland and therefore he brings suit & so forth John Doe Pled.s &C.a & Rich.d Roe And the aforesaid Richard Mastin by Philip Key his attorney Comes & Defends the force and Injury when &C.a and prays licence thereof to Imparle here to untill the Next Court to be holden at Charles Town on the Second Tuesday in November Next and he hath it and the same day is Given the said Barton her &Ca At which day to wit the Second Tuesday in November afs.d Comes as well the said Barton by his attorney afs.d as the said Richard by his attorney afs.d and the said Richard by his said attorney prays further Licence thereof to Imparle here to until the Next Court to be holden at Charles Town the Second Tuesday in March Next and he hath it and the same day is given to the s.d Barton here &Ca At which day to wit the second Tuesday in March afs.d Comes as well the said Barton by his attorney afs.d as the said Richard by his attorney afs.d and the said Richard by his said attorney prays further licence thereof to Imparle here until the Next Court to be holden at Charles Town on the Second Tuesday in June Next and he hath it and the same day is given to the said Barton here &Ca At which day to wit the Second Tuesday in June afs.d Comes as well the said Barton by his attorney afs.d as the s.d Richard by his attorney afs.d and the said ^Richard^ by his said attorney prays further licence thereof to Imparle here to until the Next Court to be holden at Charles Town afs.d on the Second Tuesday in August Next and he hath it and the same day is given to the said Barton here &Ca At which day to wit the Second Tuesday in August afs.d Comes as well the said Barton by his attorney afs.d as the said Richard by his attorney afs.d and the said Richard by his said attorney prays further Licence thereof to Imparle here until the Next Court and he hath it and the same day is given to the s.d Barton here &Ca And now here at this day to wit the Second Tuesday in Nov.r aforesaid comes as well the said Barton by his attorney afs.d as the said Richard by his atty aforesaid and the said Richard by his attorney aforesaid Produces to the Court here his Lordships Writt of Habeas Corpus in these Words following Vizt Maryland ss.t Charles Absolute Lord and Proprietary of the Provinces of maryland and Avalon Lord Baron of Baltimore &C.a To the Justices and sheriff of Charles County Greeting whereas a Certain Richard Mastin late of Charles County Planter is Detained in the Prison of our said County under the Custody of you our said sheriff at the suit of a Certain Barton Hungerford in a plea of Trespass which said plea as it is said still depends before you our said Justices undetermined as afs.d should be heard & Determined before the Justices of our provincial Court Therefore We command you that you Have the body of the said Richard Mastin by whatsoever Name he be Called in the plea afs.d with the day and Cause of his Caption & Detainer (with) |
