(210)               November Court Anno Domini 1747

And says that he Cannot deny the action afs.d of them the said Tubmans &
Hartley nor but that he did assume upon himself in manner and form as
the said Tubmans & Hartley in their Declaration afs.d above against them
hath Complained nor also but that the said Tubmans & Hartley have
sustained Damages by manes of not Performing the Promises & Assumptions
aforesaid to Nine Hundred and Nine pounds of Tobacco as the afs.d Tubmans &
Hartley above in Declaring supposes
                                                             Whereupon the said Tubmans &
Hartley by their attorney afs.d prays Judgment and there Damages so
Acknowledged together with their Costs & Charges by him about his suit in
this part sustained to them to be adjudged
                                                                         Therefore it is Considered that
the said Tubmans & Hartley Recover against the said James his Damages to
Nine Hundred and Nine pounds of Tobacco above acknowledged and also
Three Hundred and Thirty four pounds for their Costs and Charges by him
about their suit in this part laid out and Expended on his assent by the
Def.t in mer   Court here adjudged and the said James in Mercy &Ca

Trespass

Charles County ss.t    Richard Mastin late of Charles County Planter was
                                  attached to answer Barton Hungerford Sen.r of a plea wherefore 
                                  with force and Arms the Close of him the said Barton in the Co.ty
                                  aforesaid Called Batchelors Delight Containing
                                  Acres he broke and Enter'd and the Timber Trees thereon
                                  lately Growing of the Value of Fifty Pounds Current Money of
                                  Maryland he fell Custom & Carried away and other harms
                                  to him there did to great Damage of the said Barton and
                                  against the peace of the Right Honourable the Lord Proprietary
                                  that Now is his good Rule and Government and so forth
And Whereupon the same Barton by Jeremiah Chase his attorney Complains
that the said Richard Mastin the first day of May in the year of our Lord one Thous.d
Seven Hundred and forty Six with force and arms the Close of him the said Barton
broke and Enter'd and the Timber Trees of him the said Barton thereon lately
growing to wit fifty oaks to the Value of Fifty Pounds Current money of Maryland
he the said Richard out down Took and Carried away and other enormities to him
the said Barton then and there did do to the great Damage of the said Barton and
against and against the Peace of the Right Honourable the Lord Proprietary
