(187) Be it Remembered that pursuant to an order of Court Holden at Charles Town on the Second Tuesday in August last Commission Issued Returnable here &C.a To Examine Evidences touching the bounds of a Tract of Land in the said County in Possession of James Manken in the Words following Vizt Charles County ss.t Charles Absolute Lord and Proprietary of the Provinces of Maryland and Avalon Lord Baron of Baltimore &C.a To Mr John Winter Mr Benjamin Douglass Captain Samuel Chunn and M.r Peter Wood Gentlemen Whereas James Mankin holds part of a Tract of Land called Barkers Rest lying in the said County did on the Eleventh day of August & being in the Thirty Third year of our Dominion &C.a Prefer his Certain Petition in Writing to our Court that is to say to our County Court held at Charles Town in and for the said County on the day aforesaid before Robert Hanson Gent and his Associates then and Still our Justices within our County afs.d &C.a for Commission to Examine Evidences to prove and Perpetuate the memory of the Bounds of the s.d Tract of Land according to the Directions of the act of assembly late made & Provided Know ye that we have given you any Three or Two of you (not being any way Related to the Petitioner Contiguous Proprietor nor Interested in the said Land and having taken the oath prescribed by the above Named act of assembly (, full Power and Authority to Examine upon their Corporal Oaths to be by you any three or Two of you administred all Witnesses which shall be Nominated to you any three or Two of you by the above named Petitioner or other Person Concerned touching their Knowledge of the bounds of the Tract of Land above Named or the Bounds of any other lands whereon the afs.d Tract depends or whereto it Relates and therefore we Command you any three or Two of you that you Call and Cause to Come before you any three or Two of you as Witnesses Nominated at a Certain Day by you or any three or Two of you to be appointed upon the above ment.d Tract of Land and the Examination of every Witness so called before you that you any three or Two of you Receive and the same Examination you any three or Two of you carefully Reduce into Writing in the Presence of all parties Concerned that shall be there Present and the Examination so taken as afs.d you any three or two of you are to return to the Justices of our Court with all Convenient Speed under your seals or the seals of any three or Two of you together with this Writ Provided always that all Parties Concerned living within or without the County afs.d have Notice according to the Directions of the act of assembly beforementioned of the day and place of the Execution of this our Com.s before the Execution thereof and that you any Three or Two of you and to Return to our Justices aforesaid with all Convenient speed a Certificate of such Notice to gether with the Examinations of the Witnesses Witness Robert Hanson Gent (one) |
