(167 Samuel in this part should be adjudged of his Lands and Chattles should be made and Levied to and for the use of the said Samuel that if it should happen that the said George the Damages and Costs afs.d to the said Samuel should not pay or his body into the Custody of of the sheriff by Reason thereof Render And the afs.d George in his Proper Person Comes & Defends the force and Injury when &Ca and says that he Cannot deny the action afs.d of him the said nor but that he did assume upon in manner and form as the said Sam.l against him ^hath^ Complained nor also but that the said Samuel hath Sustained Damages by means of not Performing the Premises and assumptions aforesaid to Three Thousand One and Twenty Three pounds of Tobacco as the said Samuel above in Declaring Supposes Whereupon the said Samuel by his attorney afs.d prays Judgment and those Damages so acknowledged together with his Costs & Charges by him about his Suit in this part laid out and Expended to him to be adjudged Therefore it is considered by the Court here that the said Samuel do Recover against the said George his Damages afs.d to Three Thousand one Hundred and Twenty Three pounds of Tobacco above acknowledged as also the sum of Three Hundred and Seventy one pounds of Tobacco for his Costs and Charges by him about his Suit in that part laid out and Expended on his Assent by the Court here adjudged Def.t in mer and the said George in Mercy &Ca
Charles County ss.t Alexander Sims late of Charles County in the Province of Maryland Blacksmith otherwise Called Alexander Sims of Cha.s County in the province aforesaid Blacksmith was Summoned to answer unto Samuel Chunn of a plea that he render unto him the sum of Three Thousand Two Hundred Pounds of Tobacco which to him he owes and unjustly Detains and so forth And Whereupon the same Samuel Chunn by Jeremiah Chase his attorney saith that whereas the said Alexander Sims on the sixteenth Day of May in the year of our Lord one Thousand Seven Hundred and forty Three at Charles County afs.d by his Certain Writing obligatory with the seal of him the said Alexander Sums Sealed and here in Court Produced whose date is the day and year afs.d acknowledged himself to be held and firmly bound unto unto the said Samuel Chunn in the afs.d Sum of Three Thous.d Two Hundred Pounds of Tobacco to be paid to the said Samuel Chunn when thereunto afterwards he should be requested Nevertheless the said Alexander Sims altho' often Required the said sum of Three Thousand Two Hundred Pounds of Tobacco or any part thereof to the said Samuel Chunn ^hath not Paid^ to pay or in any sort Contented but the same to him the said Samuel Chunn to pay or in any sort to Content hath hither to altogether Refused and still doth Refuse to the Damage of the said Samuel Chunn Six Thousand four Hundred Pounds of Tobacco and therefore suit is brought and so forth John Doe Pled.s &C.a & Rich.d Roe |
