(166)              August Court Anno Domini 1747

Complains that whereas the said George Waple the first day of December
in the year of our Lord One Thousand Seven Hundred and forty six at Charles
County was Indebted to the said Samuel in the sum of Three Thousand One Hundred
and Twenty Three pounds of Tobacco p divers articles lying properly in an account
as by the Particular account thereof herewith into Court brought may appear and
being so thereof Indebted the said George in Consideration thereof afterwards to wit the day
and year aforesaid at the County afs.d upon himself assumed and to the said Samuel
then and there faithfully Promised that he the said George the said Sum of Three Thousand
One Hundred and Twenty Three pounds of Tobacco to the said Samuel here thereunto
afterwards he should be requested well and truly would Content  Nevertheless
the said George his Promise and Assumption afs.d not Regarding but minding &
fraudulently Intending the same Samuel in this Part craftily and subtilly to
Deceive and defraud the said George the said sum of Three Thousand one Hundred
and Twenty Three pounds of Tobacco or any part thereof to the said Samuel hath not
paid nor him for the same in any sort contented altho the afs.d by the said Samuel hath been
thereunto Requested but the same to him hitherto ^to pay or him for the same in any sort to Content the said George hath hitherto^ altogether Refused and still
doth Refuse to the Damage of the same Samuel Six Thousand Two Hundred and
forty Six Pounds of Tobacco and therefore he brings suit and so forth

of Charles Planter and becomes pledge and security for the said George that if it
should happen the said George in the plea afs.d should be Convict that then the said Matt.w
Yeilded and Granted that as well the Damages afs.d as all Costs which to the said
