(168) August Court Anno Domini 1747 And the afs.d Alexander by Henry Darnall his attorney Comes and defends the force and Injury when and so forth and Prays a hearing of the Writing obligatory afs.d and it is Read unto him and he also Prays a hearing of the Condition of the s.d Writing obligatory and it is Read unto him in these Words following to wit The Condition of the above obligation is such that if the above bounden Alexander Sims his Heirs &C.a shal and do well and truly pay unto the above mentioned Samuel Chunn his Heirs Exrs Adm.rs Assigns or Certain Attorney the sum of one Thousand Six Hundred Pounds of Good Merchantable Tobacco in Two Hogsheads to contain the same at or before the Tenth day of December Next Ensuing the Date hereof with Lawfull Interest thereon that then the above bond to be Void and of none Effect but if Default be made in payment of the Last ment.d sum of Tobacco or any Part thereof with Lawfull Interest as abovesaid then I hereby Impower any attorney Practising in any Court of Record in the Province abovesaid the Colony of Virginia or Else wherein his Majesty's Dominion to appear for me at suit of Samuel Chunn and Confess Judgment to Wither by Nildicit Cognovit Actionem or Nonsum Informatus Hereby Releasing all Errors as may happen on such Judgm.t and for so ding this shall be the same attorneys authority Witness my hand and Seal the Day and year above Written Which being Read and heard the said Alex.r by his attorney afs.d Comes and Defends the force and Injury when &C.a and the said attorney saith that he is not Informed by the same Alexander of any answer to make for the said Alexander to the s.d Samuel Chunn in the Premises nor hath he any other thing to say ^thereof^ in Barr or Preclusion of the action of the aforesaid Samuel by which the said Samuel Remain against the said Alexander thereof without Defence Therefore it is Considered that the said Samuel Recover against the said Alexander his Debt afs.d and his Damages by occasion of detaining that Debt to Two Hundred and Eighty one pounds of Tobacco to the said Samuel of his assent by the Court here adjudged and the said Def.t in mer Alexander in Mercy &Ca Mem.o the Plf Releases all but 839 and Interest
Charles County ss.t Patrick M.cQuid late of Charles County Schoolmaster otherwise Called Patrick M.cQuidd of Charles County was Sum.d to answer unto Mess.rs ^Sam.l^ Stephenson and ^Henry^ Steel Merchants in [illegible] of a Plea that he render unto them the just and full sum of Three Thousand Pounds of sound Merchantable Leaf Tobacco in Charles County which to them he owes and unjustly detains and so forth And Whereupon the same Mess.rs Stephenson & Steel by Henry Darnall their attorney saith that whereas the said Patrick M.cQuidd on the Seventh day of august In the year of our Lord One Thousand Seven Hundred and forty Six at Cha.s County afs.d by his Certain Writing obligatory with the seal of him the said Patrick (M.cQuid) |
