(161) Being Performed pray Judgment for the Writt of the Lord Proprietary of Attachment to Issue Returnable here &C.a against the Goods Chattles and Credits against the said John Marten Senior the Jurisdiction of the Court here being for as well the Damages afs.d in the Declaration afs.d mentioned as for what Costs have accrued and that further may accrue in Prosecution of the Premises Therefore it is Considered by the Court here that the said Parnhams adm.rs have the Writt of the Lord Proprietary of Attachment Returnable here &C.a against the Goods Chattles and Credits of the said John Marten Sen within the Jurisdiction of the Court here being for as well the sum of Eleven Pounds Three Shillings and a half penny as all Costs which have accrued in and about the Premises and that may here after accrue in Prosecution of the said Writt of Attachment by the Court here adjudged according to the form force and Effect of the act of assembly afs.d
Charles County ss.t Peter Fitzgerrald late of Charles County Planter was attached to answer unto George Riddell of a plea of Trespass upon the Case and so forth And Whereupon the same George by Jeremiah Chase his attorney Complains that whereas the said Peter the Ninth day of July in the year of our Lord one Thousand seven Hundred and forty Three at Charles County aforesaid was Indebted to the s.d George in the sum of Seven Hundred and four Pounds of Tobacco for article as lyes properly in an account as by the particular Account thereof herewith into Court brought may appear and being so thereof Indebted the said Peter in Consideration thereof afterwards to wit the day and year afs.d at the County afs.d upon himself assumed and to the said George then and there faithfully Promised that he the said Peter the said Sum of seven Hundred and four pounds of Tobacco to the said George when thereunto afterwards he should be requested well and truly would Content and Pay Nevertheless the said Peter his Promise and Assumption aforesaid not Regarding but minding and fraudulently Intending the same George in this Part craftily & subtilly to deceive and defraud the said Peter the said sum of Seven Hundred and four Pounds of Tobacco or any part thereof to the said George hath not paid nor him for the same in any sort Contented Altho' the said Peter afterwards to wit the first day of august In the year of our Lord one Thousand Seven Hundred and forty five and often since at Charles County afs.d by the same George was thereunto requested but the same to him hitherto to Pay or him for the same in any sort to Content hath altogether Refused and still doth Refuse to the Damage of the said George fourteen Hundred and Eight Pounds of Tobacco and therefore he brings suit and so forth John Doe Pled.s &C.a & Rich.d Roe |
