August Court Anno Domini 1747 1743 Peter Fitzgerrald D.r Tob.o 1744 Contra Cr
Whereupon into Court here in his Proper Person Comes William Middleton of Charles County Merchant and becomes Pledge and Security for the said Peter that it should happen the said Peter in the plea afs.d should be Convict that then the said William Middleton Yeilded and Granted that as well the Damages afs.d as all Costs which to the said George in this part should be adjudged of his Lands & Chattles should be made and Levied to and for the use of the said that if it should happen that the said Peter the Damages and Costs afs.d to the said George should not Pay or his body into the Custody of the sheriff by Reason thereof Render And the aforesaid Peter in his Proper Person Comes and defends the force and Injury when &C.a and says that he Cannot deny the action afs.d of him the said George nor but that he did assume upon himself in manner & form as the said George above against him hath Complained nor also but that the said George hath sustained Damages by means of not Performing the Promises and Assumptions aforesaid to seven Hundred and four pounds of Tobacco as the said George above in Declaring supposes Whereupon the said George by Jeremiah Chase his attorney aforesaid prays Judgment and those Damages so acknowledged together with his Costs and Charges by him about his suit in this part laid out and Expended to him to be adjudged Therefore it is Considered by the Court here that the said George do Recover against the said Peter his Damages aforesaid to Seven Hundred and four Pounds of Tobacco above acknowledged as also the sum of Two Hundred and fifty Nine Pounds of Tobacco for his Costs and Charges by him about his Suit in that Part laid out & Def.t in Mer Expended on his assent by the Court here adjudged and the said Peter in Mercy &C.a
It was Commanded the sheriff that he should take Aaron Nally late of Charles County Planter if &C.a and him safe keep so that you have his body before the Justices of the Lord Proprietary of his Next County Court to be holden at Charles Town on the Second Tuesday in August Next to answer unto William Middleton of a plea of Trespass upon the Case and that he should have then & there that Writt &C.a At which day to wit the Second Tuesday in August afs.d Comes the aforesaid William Middleton by Jeremiah Chase his attorney & (offers) |
