It was Commanded the sheriff that he should take John Marten Sen late of Charles County Planter if &C.a and him safe keep so that he should have his body before the Justices of the Lord Proprietary of his Next Court to be holden at Charles Town on the Second Tuesday in August Next to answer unto Jane Parnham & Francis Parnham adm.rs of all word Singular the goods and Chattles Rights & Credits which were of John Parnham late of Charles County Merchant Deceased who died Intestate as tis said of a Plea of Trespass upon the Case upon the Case and so forth and that he would have then and there Writt &C.a And now here at this day to wit the Second Tuesday in August afs.d Comes the afs.d Parnhams Adm.rs by Jeremiah Chase their attorney afs.d and offers themselves against the said John Marten Sen in the Plea afs.d the sheriff aforesaid Namely Samuel Hanson Gentleman Returns to the Court here that the said John in his Bailywick is not found and that he hath Left according to the Directions of the act of assembly in those Cases late made and Provided a Copy of the Declaration Vizt Charles County sst John Marten Sen late of Charles County Planter was Attached to answer unto Jane Parnham and Francis Parnham adm.rs of all and Singular the Goods and Chattles Rights and Credits which were of John Parnham late of Charles County Merchant Deceased who Died Intestate as tis said of a plea of Trespass upon the Case and so forth And Whereupon the said Jane and Francis Adm.rs afs.d by Jeremiah Chase their attorney Complain for that whereas the said John on the Tenth day of august In the year of our Lord one Thousand Seven Hundred and forty four at Charles County afs.d was Indebted unto the said John Parnham in his Lifetime In the sum of Eleven Pounds Three Shillings and a half penny For divers Particulars lying Properly in account as by a Particular Account thereof herewith into Court brought may appear and the said John being so thereof Indebted in Consideration thereof afterwards to wit the same Tenth day of August In the year of our Lord one Thousand Seven Hundred and forty four at the County afs.d upon himself assumed and to the same John Parnham in his Lifetime then and there faithfully Recovered that he the said John Marten Sen the said sum of Eleven pounds Three shillings and a half Penny to the said John Parnham in his Lifetime would well and truly Content and Pay when thereunto afterwards he should be requested Nevertheless the said John Marten Sen his Promise and Assumption afs.d in form afs.d made not in the least Regarding but minding and fraudulently Intending him the said John Parnham in this Part Craftily and Subtilly to deceive and defraud the said sum of Eleven Pounds Three Shillings & a half penny to him the said John in his Lifetime or to the said Jane and Francis aforesaid after the Death of the said John to who administration of all and singular the Good and Chattles Rights and Credits which were of the afs.d John Parnham at (the) |
