(158) August Court Anno Domini 1747 Hands of Patrick Maccatee the whole Damages and Costs and in the hands of Edmund Maccatee the whole Damages and Costs In the hands of Thomas Maccatee the whole Damages and Costs In the hands of William Maccatee the whole Damages & Costs In the hands of James Maccatee the ^11.th day of July 1747 the^ whole Damages and Costs In the hands of Wm Clements Sher the 18.th day of July the whole Damages and Costs and In the hands of William Robertson 2.d August the whole Damages and Costs and on the third day of August 1747 I attached in the hands of Daniel Hoskins the whole Damages and Costs and on the fifth day of August I attached in the hands of Ralph Roby the whole Damages & Costs and on the 6.th of August I attached in the hands of John Smith the whole Damages and Costs and in the hands of Tho.s Smith the whole Damages and Costs and on the 8.th day of August I attached in the hands of and in the hands of John Winn the whole Damages and Costs and in the hands of Bartholomew Hatton the whole Damages and Costs and I have made known to the Garnashees afs.d that they be appear before the Justices afs.d at the day and Place within mentioned to shew Cause why the same effects so attached in their hands should not be Condemned according to Law to and for the use of the Ex.rs within mentioned before Richard Walker John Hanson Samuel Lucket Charles Turvill Thomas Edelen Robert Middleton Basil Smith John Raly James Middleton Jun James Middleton Sen Samuel Middleton and James Mankin Good and Lawfull men of my Bailywick as now hereby Commanded So answers Sam Hanson She And the said William Robinson the sum of six shillings Currency altho Solemnly Called Comes not but makes Default and the said Daniel Hoskins the sum of Thirteen shillings Currency in like manner Called but make Default and the said Ralph Roby the sum of Ten shillings Currency in like manner Called but makes Default and the s.d Thomas Smith the sum of four shillings and six pence Currency in like manner Called but makes Default and the said John Winn the sum of Three Hundred Pounds of Tobacco in like manner Called but makes Default and the said Edmund Maccatee into Court herein his Proper Person Comes and Confesses that at the Time of Laying the attachment afs.d he had and still has of the effects of the said Murphy to the Value of Three shillings Currency and no more and the said Thomas Maccatee in like manner Confesses Seven Shill.s and six pence Currency and the said William Maccatee in like manner Confesses Twelve shillings Currency and the said James Maccatee in like manner Confesses Eight shill.s Currency and the said John Smith in like manner Confesses Nine shillings Currency and the said Bartholomew Hatton in like manner Confesses one Vise Valued at one Pound Currency Whereupon the said Askins Executors by Jeremiah Chase their attorney afs.d prays Condemnation of the several sum of money and Tobacco as afs.d so as aforesaid in the hands of the several Garnashees afs.d attached with Execution thereof to them to be adjudged Therefore it is Considered by the Court here that the said Askins Executors have Condemnation of the several sums of money and Tobacco so as afs.d in the hands of the several Garnashees so as afs.d attached by the Court here adjudged according to the form force and effect of the act of assembly in those Cases late made and Provided and that the said Askins Executors have thereof Execution &Ca Mem.o attachment struck off as to the other Garn.s William Middleton Jun secy on Cond |
