And now here at this day to wit the second Tuesday in March aforesaid Comes the said John Smith Prather by Henry Darnall his attorney afs.d and offers himself against the said Edward Jenkins in the Plea afs.d and the s.d John Smith Prather by said attorney and prays that the said Edward give special bail in the action afs.d Whereupon into Court here in his Proper Person Comes James Livers of Charles County Joyner and becomes Pledge and Security for the afs.d Edward that if it should happen that the afs.d Edward in the Plea afs.d should be Convict that then the said James Livers Yeilded and Granted that as well the Debt aforesaid as all Damages which to the same John Smith in this Part should be adjudged of his Lands and Chattles should be made and Levied to and for the Use of the said John Smith If it should happen the said Edward the Debt and Damages aforesaid to the said John Smith should not Pay or his body into the Custody of the sheriff by Reason thereof Render And the said Edward Sanders by Jeremiah Chase his attorney Comes and defends the force and Injury when &C.a and Prays Leave thereof to Imparle hereto untill the Next Court to be holden at Charles Town on the Second in June Next and he hath it and the same day is Given to the same John Smith Prather here &Ca At which day to wit the Second Tuesday in June afs.d Comes here as well the said John Smith Prather as the said Edward Sanders by their attorneys aforesaid and the said Edward Sanders by his said attorney Prays further Leave to Imparle here to untill the Next Court to be holden at Charles Town on the Second Tuesday in August Next and he hath it and the same day is given to the said John Smith here &Ca At which day to wit the Second Tuesday in August afs.d Comes here as well the sid John Smith as the said Edward Sanders by their attorneys aforesaid (and) |
