(156) August Court Anno Domini 1747 And the said Edward Sanders by his said Attorney Prays LEave to Imparle hereto untill the Next Court to be holden at Charles Town on the Second Tuesday in November Next and he hath it and the same day is given to the said John Smith Prather here &Ca At which day to wit the Second Tuesday in November afs.d Comes here as well the said John as the said Edward by their attorneys afs.d and the said Edward Sanders by his said attorney Prays Leave to Imparle here to untill the Next Court to be holden at Charles Town on the Second Tuesday in March Next and he hath it and the same day is given to the said John Smith here &Ca At which day to wit the Second Tuesday in March afs.d Comes here as well the said John Smith as the said Edward by their attorneys afs.d and the said Edward by his said attorney Prays Leave to Imparle here to untill the Next Court to be holden at Charles Town on the Second Tuesday in June Next and he hath it and the same day is given to the said John Smith here &C.a At which day to wit the Second Tuesday in June afs.d Comes here as well the said John Smith as the said Edward by their attorneys afs.d and the said Edward by his said attorney Prays Leave to Imparle hereto untill the Next Court to be holden at Charles Town on the Second Tuesday in August Next and he hath it and the same day is given to the said John Smith here &Ca And now here at this day to wit the second in August afs.d Comes as well the said John Smith Prather by his attorney afs.d and the said Edward by his attorney afs.d and the said Edward by his said attorney Comes and defends the force and Injury when &C.a and says that he Cannot deny the action afs.d and says of him the said John Smith nor but that he did assume upon himself in manner and form as the said John Smith in his Declaration afs.d above against him hath Complained nor also but that the said John Smith hath sustained Damages by means of not Performing the Promises and Assumptions afs.d to Six Pounds Ten shillings & five Pence half penny Currency as the afs.d John Smith above in declaring supposes Whereupon the said John Smith Prather by his attorney aforesaid prays Judgment and those Damages so acknowledged together with his Costs and Charges by him about his suit in this Part sustained to him to be adjudged Therefore it is Considered that the said John Smith Prather Recover against the said Edward Sanders his Damages to six pounds Three Hundred & Nine pounds of Tobacco for his Costs and Charges by him about his suit in this Part laid out and Expended on his assent by the Court here adjudged and the said Edward Sanders in Mercy &Ca
