Charles County ss.^t Edward Sanders late of Charles County Planter was attached to
                               answer unto John Smith Prather of a Plea of Trespass upon the Case

And Whereupon the said John Smith by Henry Darnall his attorney Complains
for that whereas the said Edward on the Thirteenth day of August In the year of our Lord
One Thousand Seven Hundred and forty five at Charles County afs.^d was Indebted unto the s.^d
John Smith in the sum of Six Pounds Ten Shillings and five Pence half penny Currency for
Divers Particulars lying properly in account as by a Particular Account thereof herewith into
Court brought may appear and the said Edward being so thereof Indebted in Consideration thereof
afterwards to wit the day and year afs.^d in the County afs.^d upon himself assumed and to
the same John Smith then and there faithfully Promised that he the said Edward the said
sum of Six Pounds Ten shillings and five Pence half Penny Currency to the said John Smith as [illegible]
well and truly Content and Pay when thereunto afterwards he should be requested

                                                                                        Nevertheless the said Edward
his Promise and Assumption afs.^d in form afs.^d made not in the least regarding but
minding and fraudulently Intending him the said John Smith In this Part Craftily
and subtilly to deceive and defraud the said Edward the said sum of four Pounds Ten
shillings and five pence half penny Currency or any part thereof to him the said John
Smith hath not Paid or in any sort Contented Altho' the so to the said Edward was on the
first Day of December In the year of our Lord one Thousand Seven Hundred and forty Six
and often before and since at Charles County afs.^d by the said John Smith Requested but
the said Edward the said sum of six Pounds Ten shillings and five Pence half penny Currency
or any part thereof to him the said John Smith to pay or in any sort to Content hath hither to
altogether Refused and still doth Refuse to the Damage of him the said John Smith Prather
Thirteen Pounds and Eleven pence Currency and thereof Entering a suit &C^a
