(148) August Court Anno Domini 1747 aforesaid Made and Unperformed as also four Hundred and Eighty one pounds of Tob.o which to the same Alexander Smith of his assent were adjudged for his Costs & Charges by him about his suit in this part laid out and Expended whereof the said James Mudd is Convict and that he should have then and there that Writt &Ca And now here at this day to wit the second Tuesday in August afs.d the sheriff aforesaid Returns to the Court here the Writt afs.d thus Indorsed Vizt Cepi superseeded S Hanson she and with that Writt afs.d he Returns ^in the Court here^ the following Supersedeas Viz.t Charles County ss.t You James Mudd Notley Murdock and John Marten Jun do Confess Judgment to Alexander Smith Hawkins for the sum of Thirty Thousand Pounds of Tobacco Debt and four Hundred and Eighty one Pounds of Tobacco Damage which sums were Recovered by the said Alexander Smith Hawkins against James Mudd on the Ninth day of June in Charles County Court the said Thirty Thousand Pounds of Tobacco and four Hundred Eighty one pounds of Tobacco to be Levied of your bodies goods or Chattles Lands or Tenements for the use of the said Alexander Smith Hawkins in Case the said James Mudd shall not Pay and satisfie to the said Alex.r Smith Hawkins the said Thirty Thousand Pounds of Tobacco Debt and four Hundred and Eighty one Pounds of Tobacco Costs so as afs.d Recovered against him with the additional Costs thereon on the Tenth day of February Next Confest before us the 15.th July 1747 Mem.o the Precept is Endorst Robert Hanson that the Plaintiff releases the Penalty on Paying the Prin.l S Hanson Interest and Damages It was Commanded the sheriff that he should take Thomas Mudd late of Charles County Planter &C.a and him safe keep so that you have his body before the Justices of the Lord Proprietary of his Next County Court to be holden at Charles Town on the Second Tuesday in August Next to satisfie unto Alexander Smith Hawkins as well the Sum of Thirty Thousand Pounds of Good Sound Merchantable leaf Tobacco in Cask which to the s.d Alexander Smith Hawkins in Court of the said Lord Proprietary before the Justices aforesaid were adjudged for his Damages which he had by occasion of a Certain Promise and Assumption to the said Alexander Smith Hawkins by the said Thomas Mudd at Charles County afs.d made and unperformed as also four Hundred and Eighty One Pounds which to the same Alexander Smith of his assent were adjudged for his Costs & Charges by him about his Suit in this Part laid out and Expended whereof the said Thomas Mudd is Convict and that he should have then and there that Writt &C.a And now here at this day to wit the Second Tuesday in August afs.d the she afs.d Returns to the Court here the Writt afs.d thus Indors'd Viz.t Cepi superseeded Sam: Hanson She |
