Domini 1747 John & Com by his attorney afs.d prays that the said Jeremiah to their Declaration afs.d against him may answer and because the said Jeremiah to the Declaration afs.d of him ^them^ the said John & Com does not answer nor the action afs.d in any wise Gainsay where by ^them^ the said John & Com Remains against the said Jeremiah thereupon with out defence It is therefore Considered by the Court here that the said John & Com do Recover against the said Jeremiah their Damages by occasion of the Premises (and which by the Justices of the Court here are assest to Nine pounds Currency as also Two Hundred & sixty Seven pounds of Tobacco for their Costs & Charges by him about their suit in this part laid out and Expended to the same John & Com of their assent Def.t in mer by the Court here adjudged and the same Jeremiah in Mercy &Ca
Charles County ss.t John Penn Junior late of Charles County Planter was attached to answer unto Samuel Luckett of a plea of Trespass upon the Case and so forth And Whereupon the same Samuel by Jeremiah Chase his attorney Complains That whereas the said John Penn Jun.r the Eleventh Day of June In the year of Our Lord one Thousand Seven Hundred and forty five at Charles County aforesaid was Indebted to The said Samuel In the sum of Three Pounds five Shillings and seven Pence half Penny Currency for such Things as by Properly in an account as by the Particular Account thereof herewith into Court brought may appear and being so thereof Indebted The said John in Consideration thereof afterwards to wit the day and year afs.d at the County aforesaid upon himself assumed and to the said Samuel then and there faithfully Promised that he the said John Penn Jun.r the said Sum of Three Pounds five shillings and Seven Pence half Penny Currency to the said Samuel when thereunto afterwards he should be requested well and Truly would Content and pay Nevertheless the said John Penn his Promise and assumption afs.d not Regarding but minding and fraudulently Intending the same Samuel in this part Craftilly and Subtily to deceive and Defraud the said John the said sum of Three Pounds five shillings & seven Pence half Penny Currency or any part thereof to the said Samuel hath not paid nor him for the same in any sort Contented altho the aforesaid John afterwards To wit the first day of august In the year and at the County afs.d by the same Samuel was Requested but the same to him to pay or him for the same in any sort to Content hath hitherto altogether Refused and Still doth Refuse to the Damage of the said Samuel six pounds Ten shillings Currency And therefore suit is brought and so forth fs.t John Doe C.a & Richard Roe |
