And the aforesaid John in his proper person Comes and defends the force & Injury when &C.a and prays leave thereof to Imparle until the next Court to be holden at Charles Town on the Second Tuesday in March Next and he has it and same day is given the said Samuel here &C.a And now here at this day to wit the Second Tuesday in March afs.d Comes here as well the said Samuel by his attorney afs.d as the s.d John in his proper person prays further Leave to Imparle hereto until the Next Court to be holden at Charles Town on the Second Tuesday in June Next and he has it & same day is given to the same samuel here &Ca And now here at this day to wit the Second Tuesday in June afs.d Comes as well the said John in his proper person as the said Samuel by his attorney afs.d and the said samuel by his attorney afs.d prays that the s.d John to his Declaration afs.d against him may answer and because the said John to the Declaration afs.d of him the said samuel does not answer nor the action afs.d in any wise gainsay whereby the said samuel Remains against the said John thereupon without Defence It is therefore Considered by the Court here that the said Sam.l do Recover against the said John his Damages by occasion of the Premises and w.ch by the Justices of the Court here are assest to Three pounds five shilling & seven pence half penny Currency as also Two Hundred & fifty Two pounds of Tobacco for his Costs & Charges by him about his suit in this part laid out & Expended to the same samuel Def.t in mer of his Assent by the Court here adjudged and the same John in mercy &Ca |
