(125) Jeremiah to the Declaration afs.d of him the said Thomas does not answer nor the action aforesaid in anywise gainsay whereby the said Thomas Remains against the said Jeremiah thereupon without Defence It is therefore Considered by the Court here that the said Thomas do Recover against the said Jeremiah his Damages by Occasion of the Premises and which by the Justices of the Court here are asscott to Ten pounds Currency as also Two Hundred and Thirty one pounds of Tobacco for his Costs and Charges by him about his suit in this part laid out and Expended to the same Thomas of his assent by the Court here adjudged and the same Jeremiah Def.t in mer Aderton in Mercy &Ca
Charles County ss.t Cornelius Sandford late of Charles County Innholder was att.d to answer unto John Muschett & Com of a plea of Trespass upon the Case and so forth And Whereupon the same John Muschett & Company by Jeremiah Chase their attorney Complain that whereas the said Cornelius Sandford the Third day of October in the year of our Lord one Thousand Seven Hundred and forty five at Charles County afs.d was Indebted to the said John Muschett & Company in the Sum of Thirteen Pounds fifteen shillings Currency for divers particulars lying properly in an account as by the Particular Account thereof herewith into Court brought may appear and being so thereof Indebted the aforesaid Cornelius in Consideration thereof afterwards to wit the day and year afs.d at the County afs.d upon himself assumed and to the said John & Company then and there faithfully Promised that he the aforesaid Cornelius Sandford the aforesaid Sum of Thirteen Pounds fifteen shill.s Currency to the said John Muschett & Company when thereunto afterwards he should be Requested he would well and truly Content and Pay Nevertheless the aforesaid Cornelius Sandford his Promise and Assumption aforesaid not Regarding but minding and fraudulently Intending the same John Muschett & Company in this Part craftily and subtilly to Deceive and Defraud the afs.d Cornelius Sandford the said Sum of Thirteen Pounds fifteen Shillings & Currency or any part thereof to the same John & Company hath not paid nor them nor either of them for the same in any wise Contented altho the aforesaid Cornelius Sandford afterwards to wit the Tenth day of January in the year of our Lord One Thousand seven Hundred and forty Six and often afterwards at Charles County afs.d by the same John & Company hath been Requested but the same to them or either of them hitherto to Pay or them or either of them for the same in any wise to Content hath hitherto altogether Refused and stil doth Refuse to the Damage of the same John Muschett & Company Twenty Seven Pounds Ten shillings Currency and therefore suit is brought & so forth John Doe Pled.s &C.a & Rich.d Roe |
