124) June Court Anno Domini 1747 Thomas Llanphier the said John Muschett Ralph Falkner & Thomas Llanphier then and there using Commerce the same Thomas the same order afterwards to wit the Tenth day of January In the year of our Lord one Thousand Seven Hundred & forty Six seven at Charles County afs.d to the said Jeremiah Adderton did then & there & there the said Thomas Requested the said Jeremiah Adderton to accept the said order & To pay to him the said Thomas the said sum of Money in the said order mentioned According to the Tenor of the order afs.d and the said Jeremiah then and there on sight thereof Accepted the said order according to the Custom of Merchants by Reason of which Certain Acceptance of the said order the said Jeremiah according to the Custom aforesaid used and approved became liable to pay to the said Thomas the Sum of Ten pounds Currency according to the Tenor of the order afs.d and the said Jeremiah afterwards to wit the day and year last aforesaid at the County aforesaid in Consideration of the Premises aforesaid upon himself assumed and to the said Thomas then & there faithfully Promised that he the said Jeremiah the said Sum of Ten pounds Currency in the order aforesaid mentioned to the abovesaid Thomas according to the form & Effect of the order aforesaid well and truly would Content and Pay when thereunto afterwards he should be Requested Nevertheless the said Jeremiah Adderton his Promise and Assumption afs.d not Regarding but minding and fraudulently Intending the same Thomas in this part Craftily and Subtilly to deceive and defraud the said Sum of Ten pounds Currency or any part thereof to the said Thomas hath not paid or for the same in any sort Contented altho the said Thomas Requested the said Jeremiah on the first day of February in the year of our Lord Seventeen Hundred & forty Six seven & often since at Charles County afs.d to pay the same but that to him to Pay or for the same in any sort to Content hath hither to altogether Denyd and Still doth Refuse wherefore the said Thomas saith he is the Worse and hath Damage to the Value of Twenty pounds Currency and therefore he brings suit and so forth John Doe Pled.s &C.a & Rich.d Roe Whereupon into Court here in his proper person Comes Thomas Hussey Luckett of Charles County Planter and becomes pledge and Security for the said Jeremiah that if it should happen the said Jeremiah in the plea afs.d should be Convict that then the said Thomas Hussey Luckett Yeilded and Granted that as well the Damages as all Costs w.ch to the said Thomas in this part should be adjudged of his Lands & Chattles should be made and Levied to and for the use of the said Thomas Llanphier that if it should happen that the said Jeremiah the Damages & Costs afs.d to the said Thomas Llanphier should not Pay or his body into the Custody of the Sheriff by Reason thereof Render And the aforesaid Jeremiah in his proper person Comes & defends the force and Injury when &C.a and prays Leave thereof to Imparle until the Next Court to be holden at Charles Town on the Second Tuesday in June Next and has it and the same day is given the said Thomas here &Ca And now here at this day to wit the Second Tuesday in June aforesaid Comes as well the said Jeremiah Aderton in his proper Person as the said Thomas by his attorney afs.d and the said Thomas by his attorney afs.d prays that the s.d Jeremiah to his Declaration afs.d against him may answer and because the said (Jeremiah) |
