(123) Leaf Tobacco in Cask at or upon the first day of June Next Ensuing with Legal Interest for the fine then the above obligation to be Void Else to remain and be in full force Power & Virtue in Law but if Default be made in the Payment of the said sum of Fifteen Thousand Pounds of Good sound Merchantable Leaf Tobacco in Cask then Wee Impower any Attorney in any Court of Record in the Realms of Great Britain France or Ireland or with in the Provinces of Maryland or other his Majesties Dominions to appear for us our Heirs Ex.rs and Adm.rs and Either of them at the suit of the above Named Alexander Smith Hawkins his Ex.rs Adm.rs or assigns and to Receive a Declaration on the above obligation and thereupon to Confess Judgment by Nildicit Cognovit Actionem Nonsum informatus or otherwise hereby Releasing all the Errors that may happen on the said Judgment suing out Execution thereupon or in any of the Proceedings thereunto Relating Which being Read and heard the said James by his attorney afs.d Comes & Defends the force and Injury when &C.a and the same attorney saith that he is not informed by the same James of any answer to make for the said James to the said Alexander Smith in the Premises nor hath he any other thing to Say thereof in Barr or Preclusion of the action of the afs.d Alexander Smith by which the same Alexander Smith Remains against the said James thereof with out Defence Therefore it is Considered that the said Alexander Smith Recover against the said James his Debt afs.d and his Damages by occasion of detaining that Debt to four Hundred and Eighty one Pounds of Tob.o to the same Alexander smith of his assent by the Court here adjudged and the said James in Mercy &Ca Mem.o the Plaintiff Releases the Penalty on Payment of Principal Interest & Damage Thomas Matthews Jun.r Qualified himself as Deputy Clerk of Charles County under Edmund Porteus Clerk of said County Court by taking the several Oaths Prescribed by act of Assembly and made the Declaration Called the Test and subscribed that and the oath of abjuration & also took the Oath of a Clerk
Charles County ss.t Jeremiah Aderton late of Charles County Innholder was att.d to answer unto Thomas Llanphier of a plea of Trespass upon the Case And Whereupon the same Thomas by Jeremiah Chase his attorney Complains that whereas a Certain John Muschett and Ralph Falkner at Charles County afs.d the first day of October In the year of our Lord one Thousand Seven Hundred & forty Six being Merchants Residing and being Commerce made and drens an order bearing date the day and year afs.d and the same to the said Jeremiah Adderton then and there at Charles County afs.d Residing and using Commerce Directed and by the same Order the afs.d Muschett and Falkner Requested the said Jeremiah Aderton to pay to the aforesaid Thomas Llanphier the Sum of Ten pounds Currency by the Name of M.r (Thomas) |
