May 19th 1747 Then Came William Horner before me and made oath on the Holy Evangelists of Almighty God the within accounts Just & true and that he hath not Received any Part or Parcel thereof security or satisfaction for the same more then Credit given to the best of his Knowledge I likewise Cert^i^fie that the Book from whence this account is transcribed appears to me to be Proved the 14th Feby 1745 Sworn before me Geo Bowles And the said Thomas in his Proper Person Comes & defends the force & Injury when &C.a and saith that he Cannot deny the Action afs.d of him the said John Goodwin Esq.r nor but that he did assume upon himself in manner & form as the said John against him have Complained nor also but that the said John have sustained Damage by means of not Performing the Promises & Assumptions afs.d to Nineteen shillings & six pence sterling and six Hundred & Twenty five Pounds of Tobacco as the said John above In Declaring supposes Whereupon the said John by his attorney afs.d Comes & Prays Judgment of those Damages so acknowledged together with his Costs & Charges by him about his suit in this Part laid out & Expended to him to be adjudged Therefore it is Commanded by the Court here that the said John Recover against the said Thomas his Damages afs.d to Nineteen shillings sterling and six Hundred and fifty five Pounds of Tobacco as above acknowledged as also to the sum of Thirty Two Hundred and Thirty one p.ds Tobacco for his Costs & Charges by them about his Suit in this Part laid out & Def.t in mer Expended on his assent by the Court here adjudged and the s.d Thomas in Mercy &Ca
