Charles County ss.t Thomas Willson late of Charles County Planter was attached to answer unto John Goodwin Esq.r of a plea of Trespass upon the Case And Whereupon the said John by Jeremiah Chase his attorney Complains for that whereas the said Thomas on the fourteenth day of October In the year of our Lord one Thousand Seven Hundred and forty five at Charles County afs.d was Indebted unto the said John In the sum of Nineteen shillings and Six pence sterling & six Hundred & fifty five Pounds of Tobacco for divers Particulars lying Properly in Account as by a Particular account thereof here with into Court brought may appear and the said Thomas being so thereof Indebted in Consideration thereof afterwards to wit the day & year afs.d in the County afs.d upon himself assumed and to the same John then & there faithfully Promised that the said Thomas the said Sum of Nineteen shillings & six pence sterling & Six Hundred and fifty five Pounds of Tobacco to the said John would well and truly Content & Pay when hereunto afterwards he should be requested Nevertheless the said Thomas his Promise and Assumption afs.d in form afs.d made not in the least Regarding but minding and fraudulently Intending him the said John in this Part craftily & subtilly to deceive and defraud the said Thomas the said sum of Nineteen shillings & six pence sterling & Six Hundred and fifty five Pounds of Tobacco or any Part thereof the said John hath not Paid or in any sort Contented altho so to do the said Thomas was on the first day of March In the year of our Lord one Thousand Seven Hundred and forty six and often before & since at Charles County afs.d by the said John Requested but the said Thomas the said sum of Nineteen shillings & six pence sterling and six Hundred and fifty five Pounds of Tobacco or any Part thereof to the said John to Pay or in any sort to Content hath hitherto altogether Refused and Still doth Refuse to the Damage of the said John One Pound Nineteen shills ster and Thirteen Hundred and Ten Pounds of Tobacco and therefore he brings suit &C.a John Doe Pled.s &Ca & Rich.d Roe
