          March Court                                  1740                             74

    the said George by George Douglas his attorney Complains that whereas the said Richard after the
first day of May Anno Dom MDCCV to wit one the thirtyeth day of November Anno Dom MDCCXXXVj
at the County afd did make his Certain note in writing Called a Promissary note with the proper name
of the said Richard subscribed bearing date the day and year afd and the said note to the said George Gale
then and there did deliver by which said note the said Richard did promise to pay to the said George Gale
or his order the sum of Four Pounds Currt money of maryland for value Received by means whereof and by
force of the statute in that Case lately made and provided the said Richard became Chargeable to pay to the said
George Gale the said sum in the said note mentioned according to the tenor of that note and so being thereof
Chargeable Afterwards to wit the day and year Last afd at the County afd on Consideration thereof upon
himself did assume and to the said George Gale Promise to Pay to the said George Gale the said four pounds
According to the tenor of that note  Nevertheless the said Richard his Promise afd in form afd made not
Regarding but minding and fraudulently intending the said George Gale in that part Craftilly and
Subtilly to deceive and defraud did not pay the said four Pounds to the said George Gale according to the
tenor of that Note hath not Paid or him for the same in any sort Contented but that to doe Altogether hath
Refused and still doth refuse altho' thereto afterwards to wit on the first day of May Anno Dom
MDCCXXXViij at the County afd and often since that time by the said George Gale Required
Whereupon the said George Gale says he is damnifyed eight Pounds Currt money of maryland and
thereof he brings suit &.a                                                                     Pledges &.a J: Doe & R: Roe

          A Copy of the foregoing declaration was made and sent to be served on the deft for a speedy tryall
Att which day here Came the afd George Gale by his attorney afd and the sheriffe to wit John Handy
Gent now here Returned that he had taken the afd Richard Knight whose body hereat this day
he had Ready to Answer the afd George Gale of the afd plea as to him it was Commanded   And
further the said Sherriffe Returned that he had served the afd Richard Knight with a Copy of the
foregoing decleration according to Act of Assembly in such case made and Provided &.a

          And the afd Richard Knight in his proper person Cometh and defendeth the force and Injury
when &.a and saith that he Cannot deny the action afd of the afd George Gale nor but that he did assume
upon himself in manner and form as the afd George above against him hath Complained and as to
the damage of the same George by him by Occasion of the Premisses in that part sustained the same
Richard saith and acknowledgeth that the afd George hath sustained damages by Occasion of the
Premisses beyond his Costs and Charges by him about his suit in that part apposed to Four Pounds
Currt money of maryland and not more and because the afd George denys not this but the same allegations
grants to be true prays Judgment for those damages Above acknowledged together with his Costs
