74 him it was Command And further the said sheriffe returned that he had served the af.d William King with a Copy of the foregoing declaration According to Act of Assembly in such Case made and provided &c Whereupon Came here into Court a Certain Solomon Hitch of Somerset County planter in his proper person and under teak for the said William King [Likewise the said William King present here in Court in his proper person Assumed upon himself] that if it should happen that Judgment in the plea af.d should be rendred for the same George against him the said William or that he the same William should be therein Convict that then he the said William should pay and satisfie unto the said George the Judgment of the Court thereupon or render his body in Execution of such Judgment to the prison of the sheriffe of the County af.d in satisfaction thereof or that he the same Solomon Hitch will do the same for him &c And the af.d William King in his proper person Cometh and defendeth the force and Injury when &c and saith that he Cannot deny the Action af.d of the af.d George Gale nor but that he did Assume upon himself in manner and form as the af.d George Gale above against him hath Complained and as to the damage of the same George by him by Occasion of the premisses in that part Sustained the same William King saith and Acknowledgeth that the af.d George hath Sustained damage by Occasion of the premisses beyond his Costs and Charges by him about his suit in that part apposed to Four pounds four shillings and Eight pence ^Curr money of Maryland^ and not more and because the af.d George denys not this but the same Allegation Grants to be true prays Judgment for those damages above Acknowledged together with his Costs and Charges af.d to him to be Adjudged &c Therefore by Consent of the parties af.d it is Considered that the af.d George Gale recover against the af.d William King his damages af.d to the af.d Four pounds four shillings ^and Eight pence^ Current money of Maryland by the same William 298 in form af.d Acknowledged as also Two hundred & Ninety Eight pounds of tobacco for his Costs and Charges af.d to the same George at his request by the Court now here of the Assent of the parties af.d Adjudged which Certain damages in the whole Amounts to Four pounds four shillings & Eight pence Current money of Maryland & Two hundred & Ninety Eight pounds of tobacco and the af.d William in Mercy &c
Justices of his Lordships County Court of Somerset to be held at dividing Creek in the same County the third tuesday of March Anno Dom one thousand seven hundred and forty to Answer unto George Gale of a plea of trespass upon the Case &.a and the same day is given to the afd George here &.a And hereupon the said George Gale declared against the afd Richard Knight in the plea af.d in form Following Somerset ss Richard Knight late of Somerset County planter was attached to Answer to George Gale of a plea of trespass upon the Case &.a And Whereupon the |
