68 Thereupon a Certain Aaron Lynn of Somerset County Gent present herein Court in his proper person undertook for the said Daniel Kennigan and assumed upon himself to pay all Fees due by means of the Recognizance af.d to any person or persons whatsoever in Case the said Daniel Kennigan doth not pay the same &c
in the same County the Seventeenth day of March in the Year of Our Lord One thousand seven hundred and forty before John Scott Esqr and his Associates the said Lord proprietary his Justices of the same County Court and for the same Lord propry doth give the Justices here to understand and be Informed that Mary Peacock late of Coventry parish in the County af.d Spinster the tenth day of March in the year of our Lord one thousand seven hundred and thirty nine at the parish af.d in the County af.d and within the Jurisdiction of this Court did Comit fornication with a Certain person unknown and did permit the same unknown person then and there to have Carnall Knowledge of her body and then and there to have Carnall Knowledge of her body and then and there to beget a bastard Child on the body of her the same Mary to the high displeasure of Almighty God to the Evill Example of all others in such Case offending Contrary to the peace of the said Lord proprietary that now is his good rule and Goverment and against the form of the Act of Assembly in such Case lately made and provided &c Whereupon the same Attorney of the said Lord propry prays Advice of the Court here in the premisses and that due process of Law in this part Against the af.d Mary Peacock may be made to answer the same Lord propry of and upon the premisses & Thereupon Comand was give to the sheriffe of Somerset County that he should take ^the said^ Mary Peacock if she should be found in his bailywick and her should safe keep so that he might her body here Immediately before the Justices of his Lordships County Court of Somerset now sitting at dividing Creek to answer unto his said Lordship of the Information af.d &c And afterwards to witt the same day and Year above mentioned Came here before his Lordships Justices Came the said Mary Peacock in her proper person and had a hearing of the Information afd and saith that she Cannot deny but that she if Guilty of the premisses af.d in the Information af.d specified above upon her Imposed in manner and form as by the Information af.d above upon her supposed and maketh oath that a Certain Sewel Long is the begetter of the Child she stands Inform'd against Whereupon all and singular the premisses being seen and by the Court here fully understood It is Considered by the Court here that the af.d Mary Peacock pay unto his Lordship the Lord proprietary for her fine by the Court her upon her Imposed for and by occasion of the premisses af.d whereof In form af.d she is Convict thirty Shillings Curr.t money of Maryland and that the said Mary be taken to satisfie his said Lordship of the fine af.d &c Whereupon the said Mary Peacock is ordered by the Court to give Security for the payment of all Fee or Fees due by means of the Information af.d to any person or persons whatsoever Thereupon a Certain John Williams of Somerset County Gent present herein Court in his proper person undertook for the said Mary Peacock and Assumed upon himself to pay all Fee or Fees due by means of the Information af.d to any person or persons whatsoever &c |
