65 the Seventeenth day of March Ann Dom One thousand Seven hundred and forty before his Lordships Justices Came the aforesaid Samuel Lamberson and Henry Lamberson in their proper persons according to a Certain Recognizance by them and their Securitys in this part first acknowledged and being by the Sheriffe set to the barr is Instantly ^severally^ asked how they of the felony afd in the Indictment afd above specified will thereof acquitt themselves ^thereupon^ the same Samuel Lamberson and Henry Lamberson severally say that they are not thereof Guilty and of good and evill they Severally putt themselves upon the Country and Robert Jenckins Henry Gent his Lordships attorney who for his said Lordship in this part prosecuteth in Like manner Therefore Immediately lett Come thereof the Jury before the aforesaid Justices Last nominated here &.a and who neither &a to Recognizance &a and the Jurors of that Same Jury by the aforesaid Sheriffe ot this Impannelled to witt Hutton Hill Panthur Laws David Polk John Woolford Edward Rook Thomas Pollett George Tull Littleton Townsend William Gray John White Richard Wallis John Purnall Jun.r who being Called Came who to say the truth of the premisses aforesaid upon their Oath Say that the aforesaid Samuel Lamberson and Henry Lamberson nor neither of them are Guilty of the felony in the Indictment aforesaid above specified in manner and form as the afd Samuel Lamberson and Henry Lamberson for themselves above by pleading alledged Whereupon all and singular the premisses being seen and by the Court here fully understood It is Considered that the aforesaid Samuel Lamberson and Henry Lamberson and Each of them be quiet and goe thereof without day Whereupon it is Ordered by the Court here that the aforesaid Samuel and Henry Lamberson and Each of them give security for the payment of all Fee or Fees due by means of the premisses and Indictment afd to any person or persons whatsoever Thereupon a Certain William Ellis and Abraham Lamberson of Somerset County planters both present here in Court in their proper persons undertook and each of them undertook for the aforesaid Samuel Lamberson and Henry Lamberson and Each of them for the payment of all fee or fees due by means of the prosecution on the Indictment afd to any person or persons whatsoever &a Welburn Ramsey appears herein Court according to his recognizance entered unto for his appearance at this Court to testifie on behalfe of his Lordship against Samuel and Henry Lamberson and is discharged therefrom &a Evans Davis appears here in Court according to his recognizance entered into for his appearance at this Court to testifie on behalf of his Lordship against Samuel and Henry Lamberson and is discharged therefrom &c
seven hundred and forty before John Scott Esq.r and his Associates the said Lord proprietary his Justices of the same County Court and for the same Lord proprietary doth give the same Justices to understand and be Informed that William Conner Late of Coventry parish in the said County of Somerset planter the Eighth day of February in the year of our Lord God Seventeen |
