63 and being by the Sheriffe Led to the barr is thereupon Instantly demanded how she of the felony aforesaid above upon her Imposed in the Indictment afd Mentioned would thereof acquitt her selfe saith that she is in noe sort Guilty and here upon of good and Evill she puts herselfe upon the Country and Robert Jenckins Henry Gent who for his said Lordship in this part followeth in Like manner Therefore it is Commanded the Sheriffe of the County afd that Immediately he should Cause to Come here before his Lordships Justices Twelve &.a And who neither &.a to Recognize &.a And the Jurors of that Same Jury by John Handy Gent sheriffe of the County afd to this Impannelled to witt David Polk John Woolford Edward Rooke Thomas Pollitt George Tull Littleton Townsend William Gray John White John Purnall J.r Peter Taylor John MccCuddy and Saul Townsend being Called Came who to say the Truth of the premisses aforesaid being Elected tryed and Sworn upon their Oath say that the aforesaid Ann Clark is Guilty of the felony aforesaid above upon her in form aforesaid Imposed in manner and form as by the Indictment aforesaid against her supposed Whereupon all and Singular the premisses by the Court here seen heard and fully understood Thereupon the Court here according to act of assembly in Such Case provided valued the afd One pound four shillings in Gold and Twelve Shillings and Six pence in paper Currency in the Indictment aforesaid Mentioned to be stolen to Two hundred and Sixty Two pounds of tobacco Wherefore It is Considered by the Court here that the afd Ann Clark Pay unto the afd Hugh Rimmor the party Greived four fould of the Value of the Gold and paper Currency as afd said to be Stolen and valued by the Court here as afd amounting in the whole to One thousand and forty Eight pounds of tobacco and that the said Ann Clark be whipt with fifteen stripes at the publick whiping post at dividing Creek in the County aforesaid with fifteen stripes on the bare Back well Laid on untill the blood appear and that she be set in and upon the pillowry a quarter of an hour and that she be Taken &.a and Thereupon as to the Corporall punishment afd It is Commanded the Sheriffe of the County afd that he doe thereof Immediate Execution according to the Judgmt aforesaid Rendered by whiping of the afd Ann Clark at the Publick Whiping post at the place afd with fifteen stripes on the bare Back well Laid on untill the blood appear and by setting her in and upon the pillowry a quarter of an hour &a And afterwards in the Same Court Came the said Sheriffe and returned that he had done the Execution of the Judgment afd as to the Corporall punishment afd he was Commanded Whereupon at the prayer of the afd Hugh Rimmor and according to act of assembly in such Case made and provied the afd Ann Clark is adjudged by the Court here to serve the said Hugh Rimmor his heirs or assigns four whole Years to Commence at the Expiration of her now Servitude which said four Years Service is adjudged by the Court here to be full satisfaction for the four fould afd and all fees due by means of the Indictm.t and premisses afd Likewise the said Hugh Rimmor is ordered to give Security for the payment of all fees ^due^ on the Indictmt and prosecution afd to any person or persons whatsoever Thereupon a Certain Aaron Lynn of Somerset County Gent present here in Court in his proper person undertook for the said Hugh Rimmor and assumed upon himselfe to pay the severall fees due on the Indictment afores and prosecution afd &a |
