62 against him Charged and of this he puts himself upon the Country And the aforesaid Robert Jenkins Henry who for the said Lord Proprietary in this part prosecuteth in Like manner Whereupon Command was to the Sheriffe of the County aforesaid that Immediately he should Cause to Come here before his Lordships Justices Twelve &.a and who neither &.a to recognize &.a and the Jurors of that ^same^ Jury by the aforesaid Sheriffe to him Impannelled to witt David Polk John Wollford Edward Rook Thomas Pollett George Tull Littleton Townsend William Gray John White Edward Roberts John Purnall Abraham Owten and John Gellet being Called Came who to say the truth of the premisses aforesaid being Elected Tryed and Sworn upon their Oath say that the aforesaid Patrick Connelly is not Guilty of the premisses aforesaid in the Information aforesaid above specified in manner and form as the aforesaid Patrick Connelly for himselfe above by pleading alledged Whereupon all and Singular the premisses being seen and by the Court here fully understood It is Considered that the aforesaid Patrick Connelly be quiet and goe thereof without day &a Upon which it is Ordered by the Court here that the said Patrick Connelly give security for the payment of all fee or fees that has or shall arrise due on the premisses and Information afd to any person or persons whatsoever Thereupon Came hereinto Court a Certain William Beavins of Somerset County planter and undertook for the said Patrick Connelly and assumed upon himselfe to pay all fee or fees that has or shall arrive due on the premisses and Information afd to any person or persons whatsoever &a
aforesaid to keep assigned by the Oath of Twelve Jurors being presented that Ann Clark Late of Stepney parish in the said County of Somerset spinster the ninth day of June in the year of our Lord one thousand seven hundred forty with force and arms &.c at the parish af.d in the County af.d one pound four shillings Current money of Maryland in Gold of the Value of three hundred pounds of tobacco and twelve shillings and six pence Current money in bills of Credit of the said province of Maryland of the value of one hundred pounds of Tobacco of the goods and Chattles of a Certain Hugh Rimmer then and there feloniously did steal take and bear away Contrary to the peace of the said Lord proprietary that now is his good rule and Government and against the form of the Act of Assembly in such Case thereof lately made and provided &c By which Command is to the Sheriffe of the County aforesaid that he Should Take the said Ann Clark if &.a to answer &.a And now to witt at a Court then held for the County afd at Dividing Creek in the same County the third Tuesday of June Ann Dom One thousand seven hundred and forty before his Lordships Justices Came the aforesaid Ann Clark in her proper person according to a Certain Recognizance by her and her Security in that part first acknowledged Thereupon the said Ann Clarks appearance |
