wherefore with force and arms in and upon him the said Henry at Somerset County af.d an assault he did make and him the same Henry did beat wound and evilly treat so that of his life it was much dispaired and other harms to him did to the Grievous damage of the said Henry and Contrary to the peace of the Right Honourable the Lord proprietary that now is &c And the same day is given to the af.d Henry her &a And the said Henry Barrett declared against the af.d Benjamin Grumley in the plea af.d in form following Somerset ss.t Benjamin Grumley late of Somerset County Shipwright was attached to answer unto Henry Barrett of a plea wherefore with force and arms in and upon him the said Henry at Somerset County af.d an assault he did make and him the same Henry did beat wound and evilly treat so that of his life it was much dispaired and other harms to him did to the Grievous Damage of the said Henry and Contrary to the peace of the Right Honourable the Lord proprietary that now is &c And Whereupon the same Henry Barrett by Robert Jenckins Henry his Attorney Complains that the af.d Benjamin the thirteenth day of September in the year of our Lord one thousand seven hundred and forty with force and arms to witt with Swords sticks and Knives him the said Henry Barrett at Somerset County af.d did assault and him did beat wound and evilly treat so that of his life it was much dispaired and other harms to him did to the Grievous Damage of him the said Henry Barrett and Contrary to the peace of the Right Honourable the Lord proprietary that now is his good rule and Government Whereupon he says ^that^ he is the worse and hath damage to the value of thirty pounds Curr.t money of Maryland and thereof he brings Suit &c Pl.s &a J Doe & R Roe A Copy of the foregoing declaration was made and sent to be served on the defend.t with the writt in the plea afd Att which day here Came the af.d Henry Barrett by his Attorney af.d and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d Benjamin Grumley whose body hereat this day he had ready to answer the af.d Henry of the af.d plea as to him it was Commanded &c And afterwards the third Tuesday of November One thousand seven hundred and forty at a Court then held at dividing Creek Came the aforesaid Benjamin Grumbley by William Arbuckle his attorney and the aforesaid Henry Barrett then and there his writt aforesaid against ^the said^ Benjamin Grumley did not with effect prosecute but voluntaryly permitted his suit to be discontinued Therefore afterwards to witt that same day by discretion of the Justices here were adjudged 235 to the same Benjamin Grumley pounds of tobacco for his Costs and Charges by him about his defence in that part sustained according to the form of the Statute in such Case Lately made and provided and the afd Henry in Mercy and that the afd Benjamin have thereof Execution &a Patience a negro Girle of Joshua Merrills is adjudged by the Court here to be of the age of Fourteen Years &a this Term &a |
