49 sheriffe to witt John Handy Gent now here returned that he had taken the af.d Cuthbert Russell whose body hereat this day he had ready to answer the af.d Elijah Brittingham of the af.d plea as to him it was Commanded Whereupon the af.d Cuthbert Russell puts in his place George Douglas Gent Attorney at Law against the af.d Elijah Brittingham of the af.d Plea &.a And Thereupon at the Request of the parties af.d day is to them now here given untill next Court to be held at dividing Creek the third tuesday of November then next following in the same state as at present saveing to the parties af.d &.a Att which day here Came the af.d Cuthbert Russell by his attorney af.d and the af.d Elijah Brittingham Altho' Solemnly Called Came not nor is his writt af.d against the af.d Cuthbert Russell further prosecuted &.a Therefore he and his Pledges of Prosecuting are in mercy and Lett the said Elijah Brittingham Administrator as af.d name Pledges &.a and that the af.d Cuthbert Russell goe thereof without day &.a
same day is given to the af.d Thomas here &c Att which day here Came the af.d Thomas Chase by Francis Allen his Attorney and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d Onnor Bow whose body here at this day he had ready to answer the af.d Thomas of the af.d plea as to him it was Commanded &.c Whereupon the af.d Onnor Bow puts in her place George Douglas Gent Attorney at Law against the af.d Thomas Chase of the af.d plea &c And Thereupon at the request of the parties af.d day is to them now here given untill next Court to be held at Dividing Creek the third tuesday of November then next following in the same state as at present saveing to the parties af.d &c Att which day here Came again the af.d Onnor Bow by her Attorney af.d and the af.d Thomas Chase altho' Solemnly Called Came not nor is his writt af.d against the af.d Onnor Bow further prosecuted &c Therefore he and his pledges of Prosecuting are in mercy and Let the said Thomas Chase name pledges &c and that the af.d Onnor goe thereof without day also it is Considered that the af.d Onnor Bow Recover against the af.d Thomas Chart her damages 161 by occasion of the premisses to One hundred and Eighty three pounds of tobacco to the same Onnor by discretion of the Justices here at her request for her Costs and Charges in that part Sustained according to the form of the statute in such Case lately made and provided by the Court here adjudged &c |
