held at dividing Creek the third tuesday of August Anno Dom one thousand seven hundred and forty to Answer unto Francis Lee of a plea of trespass upon the Case &.a and the same day is given to the afd Francis here &.a Att which day here Came the af.d Francis Lee by Robert Jenckins Henry his attorney and the Sheriffe to witt John Henry Gent now here Returned that he had taken the af.d John Waller whose body hereat this day he had ready to answer the af.d Francis of the af.d plea as to him it was Commanded &.c Whereupon the af.d John Waller puts in his place Francis Allen Gent Attorney at Law against the af.d Francis Lee of the af.d plea &.a And Thereupon at the Request of the parties af.d day is to them now here given untill next Court to be held at dividing Creek the third tuesday of November then next following in the same state as at present saveing to the parties af.d &.a Att which day here Came againe the aforesaid John Waller by his attorney aforesaid and the aforesaid Francis Lee altho' Solemnly Called Came not nor is his writt aforesaid against the aforesaid John Waller further prosecuted &c Therefore he and his pledges of Prosecuting are in mercy and Lett the said Francis Lee name pledges &c and that the aforesaid John Waller goe thereof without day Also it is Considered that the aforesaid John Waller Recover against the aforesaid Francis Lee his damages by Occasion of the premisses to 161 pounds of tobacco to the same John by discretion of the Justices here at his request for his Costs and Charges in that part sustained according to the form of the statute in such Case Lately made and provided by the Court here adjudged &c
Brittingham Adm.r of all and Singular the goods Chattles rights and Credits which were of John Brittingham deceased at the time of his death who died Intestate of a plea of trespass upon the Case &.a and the same day is given to the af.d Elijah here &.a Att which day here Came the af.d Elijah Brittingham by Robert Jenckins Henry his attorney and the sheriffe |
