39 of Twelve pounds Currt money of maryland and six hundred pounds of tobacco and when you have the same Attached or any part thereof the same in your Custody safe keep so that you have the same before our Justices of our County Court of Somerset to be held at dividing Creek the third tuesday of November Next then and there to be Condemned according to Act of assembly to and for the use of a Certain David Brown Unless the said William Willcox by himself or his attorney shall appear and Answer unto the said David Brown of a plea of trespass upon the Case &.a According to Law and that by good and Lawfull men of your Bailywick you make known unto the person or persons in whose hands you make the same Attachment that he she or they be and appear before our Justices of our County Court to be held as af.d to shew Cause if any he she or they be and appear before our Justices of our County Court to be held as af.d to shew Cause if any he she or they have why the same ^Goods^ Chattles Rights or Creditts so Attached in his her or their hands ought not to be Condemned and Execution thereof had and made according to Act of assembly in such case made and provided if to him her or them it shall seem meet and how you shall Execute this writt that you make known unto our said Justices at the day and place af.d and have you then and there this Writt Wittness Robert King Gent Chief Justices of the said Court the Twentieth day of August Anno Dom one thousand seven hundred and forty Att which day here Came the af.d David Brown by Robert Jenckins Henry his attorney and the sheriffe to witt John Handy Gent now here Returned the af.d Writt thereof endorsed in these words following Somerset ss I do hereby humbly Certify to the Justices within mentioned that by vertue of the within writt to me directed on the first day of October in the year of our Lord one thousand seven hundred and forty within my Bailywick I have Attached of the goods and Chattles Rights and Credits of the within named William Willcox to the Value of Twelve pounds Currt money of maryland and Six hundred pounds of tobacco in the hands Daniel Jones Thomas Covington and Thomas Durrum severally to be Condemned According to Law to and for the use of David Brown in the within writt named and I do hereby further Certify that by George Ervin and John Doe good and Lawfull men of my Bailiwick I have made known to the said Daniel Jones Thomas Covington and Thomas Durrum that they severally be and appear before the Justices within Contained at the time and place within Specified to shew Cause &.a as by that writt I am Commanded So Answers John Handy sher Whereupon the aforesaid Daniel Jones Thomas Covington and Thomas Durrum Garnishees of the aforesaid William Wilcox in their own proper persons appears and the said Daniel Jones saith that he Cannot deny but that he hath of the goods and Chattells of the said William Wilcox to One Linnen Spining wheel and One pine Chest ^and not more^ and the said Thomas Covington saith that he Cannot gaine say but that he hath in his hands of the Rights and Credits of the said William Wilcox to seven pounds Curr.t money of Maryland and not more and the said Thomas Durrum Garnishee as afd saith that he Cannot gainsay but that he hath in his hands of the goods and Chattells of the said William Willcox in his hands to thirty sheaves of unbroak flax and not more and the sayd Daniel Jones Thomas Covington and Thomas Durrum all severally say that they Cannot deny but that the afd spining wheel and Chest and seven pounds Curr.t money of Maryland and thirty sheaves of unbroak |
