40 unbroak flax so as afd by them severally Confessed Ought in their hands severally to be Condemned to the Use of the said David Brown as the goods and Chattells rights and Credits of the said William Wilcox which the said David Brown doth not gainsay &a Thereupon at the prayer of the aforesaid David Brown the Court here Valued the afd Linnen Spining wheel so as afd Confessed ^by Daniel Jones Garnishee as afd^ to fifteen shillings Currt money and the afd pine Chest to ten shillings Currt money of Maryland And the aforesaid Thirty sheaves of unbroak flax so as afd Confessed by Thomas Durrum Garnishee as aforesaid is valued by the Court here ^to^ tenn shillings Currant money of maryland Whereupon the said David Brown prays that upon giving security according to act of assembly in such Case made and provided the aforesaid Linnen spining wheel and pine Chest and seven pounds Currt money of Maryland and Thirty sheaves of unbroak flax so as aforesaid Confessed by the severall Garnishees as aforesaid as of the goods and Chattells rights and Credits of the said William Willcox may be Condemned in the hands of the af.d Severall Garnishes towards satisfying the said David Brown his Just Claim against the said William Willcox as all Costs accrewing by means of the Attachment aforesaid &.a Thereupon Robert Jenckins Henry of Somerset County Gentleman present herein Court in his proper person undertook for the said David Brown According to Act of assembly in such case provided that in Case the said William Willcox do at any time within a year and a day appear and make all or any part of the said David Browns Claim against him appear to be satisfied or otherwise to have been undue before the Laying of this Attachment that then the said David Brown shall make Restitution unto the said William Willcox of all or such part thereof as shall be made appear to be undue &.a or that he the said Robert Jenckins Henry will do ^the same^ for him &.a Therefore it is Considered by the Court here that the af.d Linnen Spining wheel and the af.d pine Chest so as af.d Confessed by the af.d Daniel Jones and Valued by the Court as af.d be Condemned in the hands of the said Daniel Jones as of the Rights and Creditts of the said William Willcox towards Satisfying unto the said David Brown as well his Just Claim against the said William Willcox as all Costs Accrewing by means of the Attachment af.d and that the said David Brown have thereof Execution &.a Also It is Considered by the Court here that the af.d sum of Seven pounds Currt money of maryland so as af.d Confessed may be Condemned in the hands of the said Thomas Covington as of the rights and Creditts of the said William Willcox towards satisfying unto the said David Brown as well his Just Claim against the said William Willcox as all Costs Accrewing by means of the Attachment af.d and that the said David Brown have thereof Execution &.a Also it is Considered by the Court here that the af.d thirty Sheaves of unbroak flax so as af.d Confessed by the af.d Thomas Durrum and valued by the Court as af.d be Condemned in the hands of the said Thomas Durrum as of the Rights and Creditts of the said William Willcox towards satisfying unto the said David Brown as well his Just Claim against the said William Willcox as all Costs Accrewing by means of the Attachment af.d and that the said David Brown have thereof Execution &.a thereupon the said Daniel Jones Thomas Covington and Thomas Durrum Garnishees as afd Are discharged from the attachmt afd &a |
