38 said Petition neither did we directly or indirectly give the said Jones or any other person whatsoever any orders for the same and unless your worships will please to Consider us by Granting the Liberty to work upon the Roads that we used to work in and that Ly adjacent to us and much more Necessary than the Road proposed by the said Jones which we beg Leave to Acquaint your Worships appears to us to be done of a View to serve his own Interest and not the Publick We beg your worships Consideration upon the facts this petition is grownded upon and your petitioner as in duty bound shall ever pray James McDaniel and others And now to witt the third Tuesday of November being the Eighteenth day of the same month Ann Dom One thousand seven hundred and forty at a Court now held before his Lordships Justices at dividing Creek Came as well the aforesaid James Mack Daniell and Others petitioners aforesaid in their proper persons as the aforesaid William Jones in his proper person and the petition ^afd^ being Read and heard and fully understood and mature deliberation thereupon had as well on the part of the petitioners afd as on the part of the afd William Jones and for as much as it appears to the Court that the aforesaid William Jones Relinquished his pretentions to the afd Road by him as aforesaid Obtained in Order for &a Wherefore it is Considered by the Court here that the afd Road to be Cleared from Out of the Indian Town into the maine Road Leading to wickacomoco near the plantation of William Davis be noe Longer a County Road and also it is Considered that the afd James Mackdaniel and Others recover against the aforesaid William Jones pounds of tobacco for their Costs and Charges by the Court here unto them adjudged and the afd William in Mercy &a
security from the Recognizance afd may be discharged Thereupon the said Jacob Messicks appearance is recorded and he and his security of and from the Recognizance afd are discharged &a
af.d may be discharged Thereupon the said Alice Coopers appearance is recorded and she and her Security of and from the recognizance af.d are discharged &c Whereupon the said Alice Cooper is Ordered give security for all fee or fees due on the Recognizance aforesaid Thereupon a Certain Jacob Messick of Somerset County planter present here in Court in his proper person undertook for the said Alice Cooper to pay all fee or fees due on the Recognizance to any person or persons whatsoever In Case the said Alice Cooper doe not pay the same &a |
