37 to give security for the payment of the severall Officers fees or other persons fees due by means of the Recognizance & Indictment afd but for want thereof the said Robert Montgomery is Committed into the Custody of the Sheriffe of the County aforesaid thereto remain &.a And afterwards in the Same Court Came a Certain William Conner of Somerset County planter in his proper person and undertook for the same Robert Montgomery to pay the several Officers (or other person or persons) fee or fees due on the Recognizance and Indictment afd In case the said Robert Montgomery doth not pay the same Thereupon the said Robert Montgomery is discharged from the Committment aforesaid &a James Hogg of Somerset County planter appeared herein Court according to a Certain Recognizance in this part first acknowledged for his appearance at this Court to give Evidence on behalfe of his Lordship against Robert Montgomery and is discharged therefrom &a
the peace in the County af.d to keep assigned by the oath of twelve Jurors being presented that Benjamin Grumley late of Somerset Parish in the said County of Somerset Shipwright the thirteenth day of September in the year of our Lord God Seventeen hundred and forty with force and Arms &.a at the Parish af.d in the County af.d within the Jurisdiction of this Court in and upon a Certain Henry Barret in the peace of God and the said Lord Proprietary that now is then and there being and assault did make and him the said Henry then and there did beat wound and evilly treat so that of his Life it was greatly dispaired and other harms to the same Henry then and there did to the Grievous damage of him the said Henry and Contrary to the peace of the right Honourable the Lord Proprietary that now is his good rule and Government Thereupon it is Commanded the Sheriffe of the County af.d that he should take the said Benjamin Grumley if he should be found in his bailywick and him should safe keep so that he might have his body here Immediately Came before the Justices of his Lordships County Court of Somerset now sitting at dividing Creek to answer unto his said Lordship of the Indictment afd &c And now to witt the third Tuesday of November being the Eighteenth day of the same month Ann Dom One thousand seven hundred and forty at a Court then held at dividing Creek before his Lordships Justices Came the aforesaid Benjamin Grumbley and had a hearing of the Indictment aforesaid and saith that he Cannot deny but that he is Guilty of the premisses af.d in the Indictment af.d Specified above upon him Imposed in manner and form as by the Indictment af.d above against him Supposed and the premisses af.d in the Indictment Expressly Acknowledged |
