according to a Certain Recognizance by him ^and his securitys^ in this part first acknowledged and prays that his appearance may be recorded and he and his security discharged &a Thereupon the said Henry Walstons appearance is recorded and he and his security discharged from the Recognizance aforesaid &a Whereupon the said Henry Walston is Ordered by the Court here to give new security for his appearance before his Lordships Justices at the next Court to be held at dividing Creek in and for the County afd the third Tuesday of March then next following to answer his Committing of fornication with a Certain Mary Miles &.a Thereupon the said Henry Walston with a Certain Samuel Wilson of Somerset County Gent his security both present here in Court in their proper persons acknowledged themselves Indebted unto his said Lordship the Lord Proprietary in Twenty pounds Currant Money of Maryland ^seperately^ of their bodys goods or Chattells Lands or Tenements to the Use of his said Lordship his heirs and successors to be made and Levied If it happen that the said Henry Walston doe not make his personall appearance before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of March then next following and doe not answer unto his said Lordship of and concerning his Committing of fornication with a Certain Mary Miles and doe not stand and abide the Judg.t of the Court thereupon and doe depart the same Court without Leave &a
arms &.a at parish afd in the County aforesaid One pair of Garters of the value of fifty pounds of tobacco of the goods and Chattells of a Certain James Hogg then and there found then and there feloniously did steal take and Bear away Contrary to the peace of the said Lord Proprietary that now is his good rule and Government and against the form of the act of assembly in such Case thereof Lately made and provided &a Testes James Hogg and Race Clark On the foregoing Bill of Indictment it was Endorsed Ignoramus Alexd Lackie foreman And now (to witt) the third Tuesday of November being the Eighteenth day of the same month Ann Dom One Thousand seven hundred and forty before his Lordships Justices at a Court then held at dividing Creek in and for the County afd Came the said Robert Montgomery in his proper person according to a Certain Recognizance by him and his security in this part first acknowledged and prays that his appearance may be recorded and he and his security discharged Thereupon the said Robert Montgomerys appearance is recorded and he and his security of and from the Recognizance afd are discharged &.a Whereupon the said Robert Montgomery is Ordered by the Court here to |
