36 Ten pounds Currant money of Maryland each of their bodys goods or Chattles Lands or tenements severally to be made and Levied to the Use of his said Lordship his heirs and successors if it happen that the said Robert Givans and Ann Richardson doe not make their personall appearance before their Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of March then next following and doe not then and there give such Evidence as they and each of them shall know on behalfe of his Lordship against Patrick Connelly of and Concerning of his receiving of stolen money of and from a Certain Ann Clark he knowing the same to be stolen and that they and Each of them doe not depart the same Court without Leave &a
of the goods and Chattells of a Certain William MaClemmey then and there found then and there feloniously did steal take and bear away Contrary to the peace of the said Lord Proprietary that now is his good rule and Government and against the form of the act of assembly in such Case made and provided &a Testes Henry Ballard W.m MccClemmey On the foregoing Bill of Indictment it was Endorsed Ignoramus Alex.d Lackie foreman And now to witt the third Tuesday of November being the Eighteenth day of the same month ann Dom One thousand seven hundred and forty at a Court then held at dividing Creek in and for the County aforesaid before his Lordship Justices Came the aforesaid George Horner Jun.r in his proper person according to a Certain Recognizance in that part first acknowledged and prays that his appearance may be recorded and he and his security accordingly discharged Thereupon the said George Horners appearance is recorded and he and his security from the recognizance afd are discharged Whereupon the said George Horner J.r is Ordered to give security for all the Officers fees and Other person or persons fees dues from the said George Horner by means of the premises and Indictment aforesaid Thereupon a Certain William Jones of Manocan in Somerset County planter present here in Court in his proper person undertook for the said George Horner J.r to pay the Severall Officers Fee or Fees or any other person or persons Fee or Fees due by means of the premisses and Indictment aforesaid In Case the said George Horner J.r doth not pay the Same &a William Macclemmey of Somerset County planter appears here in Court according to his recognizance Entered into to give evidence on behalfe of his Lordship against George Horner J.r and is accordingly discharged therefrom &a |
