309 for the County afd the third Tuesday of November then Next Following and he hath it and the same day is given to the aforesaid John Weatherington and Company here also &.a Att which day here Came againe as well the af.d John Weatherington and Company as the af.d William Lowrey by their attorneys af.d And Whereupon the said William prays further Leave thereof to Imparle here untill Next Court to be held at deviding Creek in and for the County af.d the third Tuesday of March then Next Following and he hath it and the same day is given to the af.d John Weatherington and Company here also &.a Att which day here Came againe as well the af.d John Weatherington and Company as the af.d William Lowrey by their attorneys af.d and Whereupon the said William prays further Leave thereof to Imparle here untill Next Court to be held at deviding Creek in and for the County af.d the third Tuesday of June then Next Following and he hath it and the same day is given to the af.d John Weatherington and Company here also &.a Att which day here Came againe as well the af.d John Weatherington and Company as the af.d William Lowrey by their attorneys af.d and whereupon the same attorney of the Same William saith that he is not Informed by the Same William his Clyant of any answer for the Same William to the aforesaid John and Company in the plea aforesaid to be given and nothing els thereof says by which the Same John and Company Remaineth against the aforesaid William Lowrey thereof Undefended For which Reason the Same John and Company their damages by Occasion of the premisses against the aforesaid William Lowrey Ought to recover but because it is not Known what damages the aforesaid John and Company has Sustained by Occasion of the premisses therefore at the prayer of the aforesaid John Weatherington and Company and by the Consent of the aforesaid William Lowrey the Justices here according to act of assembly in such Case made and provided assessed the Damages of the same John and Company by Occasion of the nonperformance of the promise and assumption af.d beyond their Costs and Charges ^by them^ about their suit in that part apposed to four pounds one Shilling and ten pence Current money of maryland &.a Therefore it is Considered that the af.d John Weatherington and Company Recover against the af.d William Lowrey their damages af.d to the af.d four pounds one Shilling and ten pence Current money of maryland by the Justices af.d in form af.d assessed 298 as also Three hundred and Twenty Pounds of tobacco for their Costs and |
