aforesaid or Otherwise Legally Cast that then they the said John Weatherington and Company shall pay unto the
said William Lowrey all Such Costs and Charges as should be adjudged by the Court aforesaid or that he the said
Robert Jenckins Henry will do the Same for him &a

             And hereupon the said John Weatherington and Company Complained of the aforesaid William Lowrey
in the plea aforesaid in form following
                                                                Sommerset ss  William Lowrey Late of Sommerset County planter
was attached to answer unto John Weatherington and Company of a plea of trespass upon the Case &a

    And whereupon the same John and Company by Robert Jenkins Henry their Attorney Complain that
whereas the said William the fifteenth day of January in the year of our Lord One thousand seven hundred
and forty at Somerset County the said William was Indebted unto the same John and Company the sum of six
pounds one shilling and ten pence Current money of the Province of Maryland for Sundry Articles properly
chargable in an Account as by an Account thereof here into Court brought may appear and so thereof Indebted
being the said William in Consideration thereof afterwards to witt the same day and year aforesaid at Somerset
County aforesaid upon himself did Assume and to the same John and Company then and ^there^ faithfully promise to
pay to them the aforesaid Sum of Six pounds One Shilling and ten pence when thereof afterwards he
should be requested and altho' the said William Two pounds part of the said Sum of Six pounds One
Shilling and Ten pence unto the Same John and Company he hath since paid and Satisfied  Nevertheless
the said William as to four pounds One Shilling and Ten pence of the said Six pounds One Shilling and
ten pence residue his promise and assumption aforesaid in form aforesaid made Little Regarding but
minding and fraudulently intending the Same John and Company in that part Craftily and Subtilly to deceive
and defraud the aforesaid Sum of four pounds One Shilling and ten pence or any penny thereof unto the
same John and Company (altho' the same to do the said William the said day and Year aforesaid and Often since
that time at Somerset County aforesaid by the Same John and Company Requested) hath not paid but the same
to them to pay hetherto hath Refused and still doth Refuse to the damage of the same John and Company ten
pounds Currant money of the said province of Maryland and thereof they Bring suit &a
