308 Gentleman sheriffe of the County aforesaid to this Impannelled to witt George Tull Joshua Atkinson James Houston Elijah Brittingham Christopher Glass James Townsend Micajah Brittingham Hinman Wharton William Mills William Stephens William Handy and Stephen Handy being Called Came who to say the Truth of the premisses being Elected tryed and Sworn upon their Oath say that the aforesaid David Hudson is guilty of the premisses in manner and form as the aforesaid as the aforesaid James Stephen Bredell above against him hath Complained and assessed the damages of the Same James by Occasion of the premisses beyond his Costs and Charges by him about his Suit in that part apposed to thirteen pounds twelve Shillings and Six pence Currant money of Maryland and for those Costs and Charges to One pound of tobacco And the aforesaid David Offered Exceptions in Stay of Judgm.t on the verdict aforesaid in these words following And the said David Says that Judgment on the ^said^ verdict ought not to be Rendred for the plantiffe for that the declaration wants Substance Whereupon all and Singular the premisses being seen and by the Court here fully understood It is Considered by the Court here that the aforesaid James Stephen Bredell Recover against the aforesaid David Hudson his damages 801 aforesaid by the Jurors aforesaid in form aforesaid assessed as also eigh hundred and Twenty three pounds of tobacco for his Costs and Charges aforesaid to the Same James Stephen Bredell by the Court here of his assent of Increase adjudged which Certain damages in the whole amounts to thirteen pounds Twelve Shillings and Six pence Currant 802 money of Maryland and Eight hundred and Twenty four pounds of tobacco and the aforesd David in mercy &a
of June Ann Dom One Thousand Seven hundred and forty One to answer unto John Weatherington and Compa of a plea of trespass upon the Case &a and the Same day is given to the afd John and Compa there &c Att which day here Came the aforesaid John Weatherington and Company by Robert Jenckins Henry their attorney and the Sheriffe to witt John Handy Gent now here Returned that he had Taken the aforesaid William Lowrey whose body here at this day he had ready to answer unto the aforesaid John Weatherington and Company of the aforesaid plea as to him it was Commanded Whereupon the said William Lowrey puts in his place George Douglas Gent attorney at Law against the aforesaid John Weatherington and Company of the afd plea And Thereupon at the Request of the parties aforesaid day is to them now here given untill next Court to be held at dividing Creek in and for the County aforesaid the third Tuesday of august then next following in the Same State as at present Saving to the parties aforesaid &a Att which day here Came againe as well the aforesaid John Weatherington and Company as the aforesaid william Lowrey by their attorneys aforesaid and where the said William prays that the aforesaid John and Company may give Security for Costs in Case they be non suit in the plea afd Thereupon Robert Jenckins Henry ^Gent^ present here in Court undertook for the said John Weatherington and Company ^that if they^ should be nonsuit in the plea afd |
