304 him Should Safe keep so that he might have his body before the Justices of his Lordships County Court of Sommerset to be held at dividing Creek the third Tuesday of March Ann Dom One Thousand Seven hundred and forty one to answer unto James Baker of a plea of trespass upon the Case &.a and the Same day is given to the afd James there &a Att which day here Came the af.d James Baker by Robert Jenckins Henry his Attorney and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d George Clifton whose body here at this day he had ready to answer the af.d James Baker of the af.d plea as to him it was Commanded Whereupon the said George Clifton present herein Court in his proper person at the prayer of the af.d James Baker is adjudged to give special bail to the Action af.d Thereupon a Certain Thomas Hobbs of Somerset County planter present herein Court in his proper person under took for the said George Clifton (Likewise the said George Clifton present herein Court as af.d Assumed upon himself) that if it should happen that that he the same George should be therein Convict that then he the said George should pay and satisfie unto the said James Baker the Judgment of the Court thereupon or render his body in Execution of Such Judgment to the prison of the sheriffe of the County af.d in satisfaction thereof or that he the same Thomas Hobbs will do the same for him &c And Whereupon the said George Clifton by George Douglas his Attorney Comes and defends the force and Injury when &c And Saving to himselfe all manner of Advantages and Exceptions to the writt aforesaid prays Leave thereof to Imparle here untill next Court to be held at dividing Creek the third Tuesday of June then next following and he hath it and the Same day is given to the aforesaid James here &a Att which day here Came again as well the af.d George Clifton by his Attorney af.d and the af.d James Baker altho' Solemnly Called Came not nor is his writt af.d against the af.d George Clifton further prosecuted &c Therefore he and his pledges of prosecuting are in mercy and let the said James Baker name pledges &c and that the af.d George Clifton goe thereof without day also it is Considered that the af.d George Clifton recover against the af.d James Baker his Damages af.d by Occasion of the premisses to: 195 pounds of tobacco to the same George by discretion of the Justices hereat his request for his Costs and Charges in that part sustained According to the form of the statute in such Case lately made and provided by the Court here adjudged &c |
