303 said Ignatius (Likewise the Same Ignatius Haddock present here in Court as aforesaid assumed upon himselfe) that If it should Happen that Judgment in the plea aforesaid should be Rendered for the Same Henry against the Same Ignatius or that he the same Ignatius should be therein Convict that then he the said Ignatius should pay and Satisfie unto the Same Henry Lowes the Judgment of the Court thereupon or Render his body to the prison of the Sheriffe of the County aforesaid in Satisfaction thereof or that he the said James Knight will do the Same for him &a And here upon the said Henry declared against the aforesaid Ignatius in the plea aforesaid in form following Sommerset ss Ignatius Haddock Late of Somerset County planter Otherwise Called Ignatius Haddock of Somerset County planter was Summoned to answer unto Henry Lowes of a plea that he Render unto him One thousand and Twenty Six pounds of tobacco which to him he Owes and Unjustly detaines &a And Whereupon the same Henry by William Arbuckle his attorney saith that whereas the afd Ignatius the Twenty seventh day of December Ann Dom Seventeen hundred and thirty nine at Sommerset County by his Certain Bill Obligatory which the Same Henry with the Seal of the said Ignatius Sealed hereinto Court brings whose date is the Same day and Year aforesaid bound himselfe his heirs Executors and Adm.rs in the aforesaid Sum of One Thousand One hundred and Twenty Six pounds of tobacco for the payment of five hundred and Sixty three pounds of tobacco to the aforesaid Henry and his assignes on or before the Twenty fifth day of December next Ensuing the date of the said Bill and the aforesaid Ignatious the aforesaid Tobacco upon the Twenty fifth day of december to the Same Henry hath not paid which to him he Ought to have paid according to the form and Effect of the said Bill by which action accrews to the said Henry to have and require of the aforesaid Ignatius the aforesaid One thousand One hundred and Twenty Six pounds of tobacco Nevertheless the said Ignatius altho' Often Required the aforesaid tobacco the Same Henry hath not Satisfied nor paid but the Same to pay hitherto altogether hath denyed and Still doth deny Whereupon the Same Henry saith he is damnified and damage hath to the Value of Twenty pounds Currant money of Maryland and thereof he brings Suit &a pldgs de p Jno Doe R Roe And whereupon the said Ignatius Haddock in his proper person Comes and defends the force and Injury when &a and saith that he Cannot deny the action aforesaid of the aforesaid Henry Lowes nor Can he say but the writing aforesaid is his deed nor Can he say but that he Owes the Same Henry the aforesaid One Thousand One hundred and Twenty Six pounds of tobacco in manner and form as the afd Henry above against him hath declared &a Therefore it is Considered that the aforesaid Henry Lowes Recover against the aforesaid Ignatius Haddock his debt aforesaid and his damages by occasion of the detention of the Same debt to 268 pounds of tobacco to the Same Henry of his assent by the Court here adjudged and the aforesaid Ignatius in Mercy &a alphabeted so far
