at Dividing Creek the third Tuesday of March Anno Dom one thousand seen hundred and forty two to answer unto James Townsend of a plea of trespass upon the Case &c and the same day is given to the af.d James there &c Att which day here Came the af.d James Townsend by Francis Allen his Attorney and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d Robert Geddes whose body here at this day he had ready to answer the af.d James Townsend of the af.d plea as to him it was Commanded &c Whereupon the af.d Robert Geddes puts in his place Robert Jenckins Henry Gent Attorney at Law against the af.d James Townsend of the af.d plea And thereupon at the request of the parties af.d day is to them now here given untill next Court to be held at Dividing Creek in and for the County af.d the third Tuesday of June then next Following in the same state as at present saveing to the parties af.d &c Att which day here Came again the af.d Robert Geddes by his Attorney af.d and the af.d James Townsend altho' Solemnly Called Came not nor is his writ af.d against the af.d Robert Geddes further prosecuted &c Therefore he and his pledges of prosecuting are in Mercy and let the said James Townsend name pledges &c and that the af.d Robert Geddes goe thereof without day also it is Considered that the af.d Robert Geddes recover against the af.d James Townsend his Damages af.d b y Occasion of the premisses to 165 pounds of tobacco to the same Robert by discretion of the Justices hereat his request for his Costs and Charges in that part sustained According to the form of the statute in such Case lately made and provided by the Court here adjudged &c
seven hundred and forty one to satisfie Sarah Brittingham Exrx of the testament and last will of Nathaniel Brittinghams deceas.d of a plea of trespass upon the Case &c and the same day is day is given to the af.d Sarah there &c Att which day here Came the af.d Sarah Brittingham by George Douglas her Attorney and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d Elijah Brittingham whose body hereat this day he had ready to answer |
