two to answer unto Henry Lawrance of a plea of trespass upon the Case &c and the same day is given to the af.d Henry here &a Att which day here Came the af.d Henry Lawrance by Robert Jenckins Henry his Attorney and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d William Woodcraft whose body here at this day he had ready to satisfie the af.d Henry Lawrance of the af.d plea as to him it was Commanded And the af.d Henry Lawrance Complained of the af.d William Wood Craft in the plea af.d in form Following Somerset St/ William Wood Craft late of Somerset County planter was attached to answer unto Henry Lawrance of a plea of trespass upon the Case &c And Whereupon the same Henry Lawrance by Robert Jenckins Henry his Attorney Complains that whereas the af.d William the seventh day of January in the year of our Lord one thousand seven hundred thirty and nine at Somerset County was Indebted unto the same Henry Lawrence in the sum of three pounds and five shillings Curr.t money of the province of Maryland for sundry Goods wares and merchandizes by the same Henry Lawrence to to the said William at the speciall Instance and request of the said William before that time sold and delivered and so thereof Indebted being the said William in Consideration thereof afterwards (to witt) the same day and year af.d at Somerset County af.d upon himself did assume and to the same Henry Lawrence then and there faithfully promise that he the said William the sum of money af.d unto the same Henry Lawrence when thereto afterwards requested he would well and faithfully pay and Content Nevertheless the af.d William his promise and assumption af.d in form af.d made little regarding but minding and fraudulently intending the same Henry Lawrence in that part Craftily and Suttlely to deceive and defraud the af.d sum of three pounds and five shillings or any penny thereof unto the same Henry Lawrance Altho' the same to do the said William afterwards (to witt) the same day and year af.d and often since at Somerset County by the same Henry Lawrence was requested (hath not paid or him for the same Contended but the same to him to pay or Content hetherto hath refused and still doth refuse to the Damage of the same Henry Lawrance Ten pounds Curr.t money af.d and thereof he brings Suit &a Pledg.s &c J Doe & R Roe And the af.d William Wood Craft by William Arbuckle his Attorney Comes and defends the force and Injury when &c and saith that he Can not deny the Action af.d of the af.d Henry Lawrence nor Can he say but that he did Assume upon himself in manner and form as the af.d Henry Lawrance above against him hath Complained and as to |
