    June Court                      1742                302

to the best of his Knowledge is Just and True and that he hath not directly nor Indirectly Received any
part or parcell thereof or any Security or Satisfaction for the Same sworn before me this 31 day of
March 1742                                                                     ADashiell

                Whereupon the said Thomas Smith present herein Court in his proper person at the prayer
of the af.d Richard Parker is adjudged to give special bail to the Action af.d  Thereupon a Certain John
Nelson of Somerset County planter present herein Court in his proper person undertook for the said Thomas
Smith (Likewise the said Thomas Smith present herein Court as af.d assumed upon himself) that if it should
happen that Judgment in the plea af.d should be rendred for the af.d Richard Parker against the same
Thomas Smith or that he the same Thomas should be therein Convict that then he the said Thomas
should pay and satisfie unto the said Richard Parker the Judgment of the Court thereupon or render
his body in Execution of such Judgment to the prison of the sheriffe of the County af.d in satisfaction
thereof or that he the same John Nelson will do the same for him &c

               And the af.d Thomas Smith in his proper person Cometh and defendeth the force and Injury
when &c   and saith that he Cannot Deny the Action af.d of the af.d Richard Parker nor Can he say but that he
did Assume upon himself in manner and form as the af.d Richard Parker above against him hath Complained
and as to the damage of the same Richard by him by Occasion of the premisses in that part sustained the same
Thomas saith and acknowledgeth that the af.d Richard hath sustained Damages by Occasion of the premisses
beyond his Costs and Charges by him about his suit in that part apposed to three pounds nineteen shillings and
Seven pence half penny Curr.t money of Maryland and not more and because the af.d Richard denys not this but
the same allegation grants to be true prays Judgment for those damages above acknowledged together with his
Costs and Charges af.d to him to be adjudged &c

                   Therefore by Consent of the parties af.d it is Considered that the af.d Richard Parker recover against
the af.d Thomas Smith his Damages af.d to the af.d three pounds nineteen shillings and seven pence half penny
Curr.t money of Maryland in form af.d acknowledged as also
301            pounds of tobacco for his Costs and Charges af.d to the same Richard at his request by the Court now here
adjudged which Certain Damages in the whole amounts to three pounds nineteen shillings and seven pence half penny
Curr.t money of Maryland and                                                                                          pounds of tobacco and the
af.d Thomas in mercy &c
