  Thomas Smith

    Command was given to the Sheriffe of Sommerset County that he Should Take Thomas Smith Late
of Somerset County planter if he Should be found in his bailywick and him should safe Keep so that
he might have his body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the
third Tuesday of June Ann Dom One Thousand Seven hundred and forty Two to answer unto Richard Parker
of a plea of trespass upon the Case &.a  and the Same day is given to the aforesaid Richard here &a

               Att which day here Came the aforesaid Richard Parker by Robert Jenckins Henry his attorney and
the Sheriffe to witt John Handy Gentleman Now here Returned that he had Taken the aforesaid Thomas Smith whose body at
this day he had here Ready to answer the aforesaid Richard Parker of the aforesaid plea as to him it was Commanded

             And the aforesaid Richard Parker Complained of the aforesaid Thomas Smith of the aforesaid plea in form following
Sommerset ss   Thomas Smith Late of Somerset County planter was attached to answer unto Richard Parker of a plea
of trespass upon the Case &a

                               And Whereupon the said Richard by Robert Jenckins Henry his attorney Complaines that whereas
    the aforesaid Thomas the fifteenth day of October in the Year of Our Lord One Thousand Seven hundred forty and One at
    Somerset County aforesaid was Indebted unto the Same Richard in the Sum of three pounds Nineteen Shillings and Seven
pence halfe penny Currant money of ^the province of^ Maryland for Sundry articles properly Chargable in an account (as by an account thereof
here into Court brought may appear) and so thereof Indebted being the aforesaid Thomas afterwards (to witt) the same day and
Year aforesaid at the County aforesaid in Consideration thereof upon himselfe did assume and to the Same Richard then and there
faithfully promise that he the said Thomas the Sum of money aforesaid unto the same Richard when thereto afterwards thereto
Requested he would well and faithfully pay and Content  Nevertheless the aforesaid Thomas his promise and assumption aforesaid
in form aforesaid made Little Regarding but minding and fraudulently Intending the Same Richard in that part Craftilly and Subtilly
to deceive and defraud the aforesaid Sum of three pounds Nineteen Shillings and Seven pence halfe penny or any penny thereof
unto the Same Richard (altho' the Same to do the Same Thomas afterwards (to witt) the Same day and Year aforesaid and often times
Since at Sommerset County aforesaid by the Same Richard was requested hath not paid or him for the Same in any Sort Contented but
the Same to him to pay or Content hetherto hath Refused and Still doth refused to the damage of the Same Richard Ten pounds Currant
money of the province aforesaid and thereof he brings Suit &.a                        pledges de ps John Do & R Roe
