294 Action af.d of the af.d Jacob Hindman nor but that he did assume upon himself in manner and form as the af.d Jacob Hindman above against him hath Complained and as to the damage of the same Jacob by him by Occasion of the premisses in that part sustained the same William Willoughby James saith and Acknowledgeth that the af.d Jacob hath sustained Damages by him by Occasion of the premisses beyond his Costs and Charges by him about his suit in that part apposed to five shillings and five pence Curr.t money of Maryland and four hundred and thirty two pounds of tobacco and not more and because the af.d Jacob Hindman denys not this but the same allegation grants to be true prays Judgment for those damages above acknowledged together with his Costs and Charges af.d to him to be adjudged &c Therefore it is Considered that the aforesaid Jacob Hindman Recover against the aforesaid William Willoughby James his damages aforesaid to the aforesaid five Shillings and five pence Currant money of Maryland and four hundred and thirty two pounds of tobacco by the same William Willoughby James in form aforesaid acknowledged as also Two hundred and Sixty Six pounds of tobacco for his Costs and Charges aforesaid to the Same Jacob at his request by the Court now here adjudged and the aforesaid William in Mercy &a And afterwards to witt the fifteenth day of June Ann Dom One Thousand Seven hundred and forty Two the said William Willougby James present herein Court in his proper person And whereupon the same William Willoughby James at the prayer of the aforesaid Jacob Hindman is Committed into the Custody or prison of the Sheriffe of the County aforesaid there to remain untill the said Jacob of his damages Costs and Charges aforesaid should be thereof fully Satisfied Whereupon the said Sheriffe to witt John Handy Gent present herein Court took Charge of the said William Willoughby James accordingly &a
the third Tuesday of June Ann Dom One Thousand Seven hundred and forty Two to Satisfie Benjamin Warrington of Eight pounds Currant money of Maryland and three hundred and eighty seven pounds of tobacco which to the Same Benjamin in his Lordships County Court of Sommerset before the Justices thereof at dividing Creek were adjudged for his damages which he had by Occasion of a Certain promise and assumption to the Same Benjamin by the aforesaid James made and not performed whereof he is Convict &a Att which day here Came the aforesaid Benjamin Warrington in his proper person and the Sherriffe (to witt) |
