293 nine pence pcell of the af.d one pound six shillings and two pence to the said Jacob he hath paid and satisfied yett as to Five shillings and Five pence residue of the said one pound six shillings and two pence and the af.d four hundred and thirty two pounds of tobacco the said William Willoughby James his promise and assumption af.d in forme af.d made nothing regarding but plotting and fraudulently intending the said Jacob in that part Craftily and Subtilly to deceive and defraud the said five shillings and five pence and four hundred and thirty two pounds of tobacco to the said Jacob he hath not paid altho' the same to do by the said Jacob on the af.d tenth day of March in the year af.d and often afterwards at the County aforesaid he was thereunto Requested but the Same to him hitherto to pay hath Refused and Still doth Refuse and deny to the damage of the said Jacob of Eight pounds Currant money of Maryland and thereupon he brings Suit &a Pledgs de p Jno Doe & R Roe
And the aforesaid William Willoughby James being present herein Court in his proper person at the prayer of the aforesaid Jacob Hindman by his attorney aforesaid is adjudged to give Special Bail tot he action afd but for want thereof the Same William Willoughby James is Committed to the prison of the Sheriffe of the County aforesaid there to remaine &.a the said Sheriffe present herein Court took Charge of the said William Willoughby James accordingly to have his body at next Court to be held at dividing Creek in and for the County aforesaid the third Tuesday of march then next following and the Same day is given to the aforesaid Jacob here &a Att which day here Came againe as well the aforesaid Jacob Hindman by his attorney aforesaid as the aforesaid William Willoughby James in his proper person in Custody of the Sheriffe aforesaid and thereupon further day is given to the aforesaid William Willoughby James in Custody of the aforesaid Sheriffe as aforesaid untill next Court to be held at dividing Creek the third Tuesday of June then next following and the Same day is given to the aforesd Jacob here &c Att which day here Came againe as well the aforesaid Jacob Hindman by his attorney afd as the aforesaid William Willoughby James in his proper person in Custody as aforesaid And whereupon the said William Willoughby James in Custody as aforesaid defends the force and Injury when &a and Saith that he Cannot deny the action |
