293 Maryland and for those Costs and Charges to One pound of tobacco Therefore it is Considered that the aforesaid David Wilson Recover against the aforesaid Woney Maclemey his damages aforesaid by the Jurors aforesaid in form aforesaid assessed as also Seven Hundred and 789 Eighty Nine pounds of Tobacco for his Costs and Charges aforesaid to the Same David Wilson by the Court here of his assent of Increase adjudged which Certain damages in the whole amount to Eleven pounds 790 Currant money of Maryland and Seven hundred and ninety pounds of tobacco and the afd Woney in Mercy &a
tuesday of November Anno Dom one thousand seven hundred and forty one to answer unto Jacob Hindman of a plea of trespass upon the Case &c and the same day is given to the af.d Jacob here &c Att which day here Came the af.d Jacob Hindman by Francis Allen his ^attorney^ and the sheriffe to witt John Handy Gent now here returned that he had taken the af.d William Willoughby James whose body hereat this day he had ready to answer the af.d Jacob Hindman of the af.d plea as to him it was Commanded And hereupon the af.d Jacob Hindman Complained of the af.d W.m Willoughby James in the plea af.d in form Following Somerset ss/ William Willoughby James late of Somerset County planter was Attached to answer unto Jacob Hindman of a plea of trespass upon the Case &c And Whereupon the said Jacob by Francis Allen his Attorney Complains that whereas the said William Willoughby James the tenth day of March Anno Dom seventeen hundred and forty at the County of Somerset af.d within the Jur of this Court was Indebted unto the said Jacob in one pound six shillings and two pence Curr.t money of Maryland and four hundred and thirty two pounds of tobacco for sundrys properly Chargeable in Acc.t as by Account thereof ready herein Court to be produced may appear and being so thereof Indebted the said William Willoughby James in Consideration thereof the day and year af.d at the County af.d upon himself did assume and to the said Jacob then and there did faithfully promise that he the said William Willoughby James the said one pound six shillings and two pence and four hundred and thirty two pounds of tobacco to the said Jacob when he should be thereunto requested he would well and faithfully pay and Content And altho' the said William Willoughby James one pound and Nine |
